Statute Text
Credit
for room, board, tuition and fees for students ordered to active duty; rules.
(1)(a) The amount of the credit
specified in ORS 353.200 (1)(b) shall be based on:
(A) The amount of
room and board paid by the student for a term that the student does not
complete because the student is ordered to active duty; and
(B) The amount of
tuition and fees paid by the student for a course from which the student
withdraws.
(b) The amount of
the credit shall be prorated based on the number of weeks remaining in the term
or course when the student withdraws.
(c) At the time a
student withdraws from a course at the Oregon Health and Science University or
from the university, the student must elect to claim the credit:
(A) As a credit
toward tuition and fees or room and board if the student reenrolls at the
university under ORS 353.200 (1)(c); or
(B) As a monetary
payment.
(2) A student who
elects to claim the credit by the method described in subsection (1)(c)(A) of
this section may change the method of claiming the credit to the method
described in subsection (1)(c)(B) of this section by giving notice to the
university.
(3) A student who
elects to claim the credit by the method described in subsection (1)(c)(A) of
this section must use the credit or change the method of claiming the credit
under subsection (2) of this section within one year after release from active
duty.
(4) A personal
representative of a student who elected to claim the credit by the method
described in subsection (1)(c)(A) of this section may claim a monetary payment
upon presenting evidence to the university that the student died while serving
on active duty.
(5) The Oregon
Health and Science University Board of Directors shall adopt rules for the
administration of this section, including rules that determine the amount of
credit and the method by which the credit is prorated. [2005 c.170 §9]
