Statute Text
Warrant
in case of refusal or neglect to obey writ.
If the person upon whom the writ was duly served
refuses or neglects to obey the same by producing the party named in the writ
and making a full and explicit return thereto within the time required, and no
sufficient excuse is shown therefor, the court or judge before whom the writ
was made returnable shall, upon due proof of the service thereof, forthwith
issue a warrant against such person, directed to any sheriff in this state,
commanding the sheriff forthwith to apprehend such person and bring the person
immediately before such court or judge; and on the person being so brought, the
person shall be committed to close custody in the jail of the county in which
such judge shall be until the person makes return to the writ and complies with
any order made in relation to the party for whose relief the writ was issued.
