Statute Text
Payment
of charges when service is on person other than sheriff or other officer.
Every court or judge allowing a
writ of habeas corpus, directed to a person other than a sheriff or other
officer, may require, in order to render the service effectual, that the
charges of producing the party be paid by the applicant; and in such case the
court or judge shall, in the order allowing the writ, specify the amount of
such charges, which shall not exceed the fees allowed by law to sheriffs for
similar services.
