Listed
transaction understatement; penalty.
(1) If a taxpayer has a listed transaction understatement for a tax year, there
shall be added to the tax liability of the taxpayer for the tax year a penalty
equal to 60 percent of the amount of the understatement.
(2) The penalty
imposed under this section applies to listed transaction understatements
discovered or reported on or after January 1, 2008, and is in addition to and
not in lieu of any other penalty.
(3) As used in
this section, listed transaction understatement means the sum of:
(a) The amount
determined by multiplying the highest rate of tax imposed on the taxpayer under
ORS chapter 316 or, if the taxpayer is a corporation, under ORS chapter 317 or
318, by any net increase in taxable income that results from a difference
between the proper tax treatment of a listed transaction and the treatment of
the transaction on the return of the taxpayer; and
(b) The amount of
any decrease in the aggregate amount of credits determined for purposes of ORS
chapter 316 or, if the taxpayer is a corporation, for purposes of ORS chapter
317 or 318, that results from the taxpayers treatment of a listed transaction
and the proper tax treatment of that transaction.
(4) The
Department of Revenue may by rule further define listed transaction
understatement consistent with ORS 314.307 and subsection (3) of this section.
