Protection of confidentiality of industrial property information obtained by
subpoena.
(1) When
the Department of Revenue or any person has obtained information concerning
industrial property by subpoena issued under ORS 305.190 or 305.420, and the
provider of the information has designated the information as confidential, the
confidentiality of the information shall be protected as provided in this
section.
(2) If the
department or any person in possession of information described in subsection
(1) of this section intends to use that information in a judicial proceeding,
the court shall close the proceedings to anyone other than representatives of
the parties to the proceeding at any time the confidential information is
presented as evidence. The court shall limit the disclosure of the information
to representatives of the parties to the proceeding as provided in ORS 305.398.
The court also shall seal those parts of the record of the proceeding that
contain confidential information. This subsection shall apply to proceedings on
appeal from the court proceeding. [1993 c.353 §10; 1995 c.650 §85]
