Liability for certain medical treatment at facilities other than Oregon Health and Science University. (1) For the purposes of ORS 30.260 to 30.300, all services constituting patient care, including, but not limited to, inpatient care, outpatient care and all forms of consultation that are provided at a location other than the Oregon Health and Science University campus or one of the Oregon Health and Science University clinics are within the scope of state employment or duties when: (a) Provided by members of the Oregon Health and Science University faculty or staff, Oregon Health and Science University students under prior written express authorization from the president of the Oregon Health and Science University or a representative of the president to provide those services at that location; (b) The services provided are within the scope of the express authorization; and (c) The Oregon Health and Science University: (A) Derives revenue in a similar amount or percentage as it would for care rendered on the Oregon Health and Science University campus or at an Oregon Health and Science University clinic; or (B) Is performing a salaried, nonfee-generating or volunteer public community or nonfee-generating educational service by providing the services. (2) For the purposes of ORS 30.260 to 30.300, services constituting patient care that are provided at a location other than the Oregon Health and Science University campus or one of the Oregon Health and Science University clinics are not within the scope of state employment or duties when: (a) Such services constitute an exclusively private relationship between the patient and a person described in subsection (1)(a) of this section; and (b) The requirements of subsection (1)(b) and (c) of this section are not met.
