Compensation of reference judge; payment procedure.
(1) Unless otherwise agreed by the
parties, the compensation of a reference judge to whom an action is referred
under ORS 3.305 shall be an amount for each day actually engaged in the
performance of duties under the referral and in the conduct and disposition of
post-trial proceedings under ORS 3.315 (6) equal to five percent of the gross
monthly salary of a regularly elected and qualified judge of the circuit court,
or one-half of that daily compensation for services of one-half day or less.
(2) Payment of
the compensation of a reference judge and the expense of the trial on reference
before the reference judge shall be the obligation of the parties. The
obligation shall be borne equally by the parties unless the parties agree to a
different allocation.
(3) The presiding
judge for the judicial district shall estimate the compensation of the
reference judge and the expense of the trial on reference in advance of the
trial, and shall notify the parties of the estimate. The parties shall deposit
with the clerk of the court the amount estimated by the presiding judge. The
presiding judge may order the clerk to pay a portion of the deposited amount to
the reference judge during the trial on reference. Upon termination of the
referral of the action, the reference judge shall cause to be delivered to the
presiding judge and each party a written statement of any remaining unpaid
compensation and expense. The presiding judge shall hear and decide any
objection to the written statement, and thereafter shall order payment to the
reference judge or refund of any remainder of the deposited amount accordingly.
