or 275.200, the governing body of a county may, by order made and
entered in its records, declare the breach or default and cancel the land sale
contract or enter into a new purchase agreement in writing. If the land sale
contract is canceled and the holder is found within the county, a certified
copy of the order shall be served as a summons is served by the sheriff upon
the holder of the canceled land sale contract. If the land sale contract is
canceled and the holder is not found within the county, a certified copy of the
order shall be served by mailing it to the holder by registered mail or by
certified mail with return receipt at the last-known address of the holder.
Return of such service shall be made upon such copy of order.
(2) Within 20
days after the service of the order of cancellation upon the holder, the holder
of the canceled land sale contract may appeal from the order to the circuit
court for the county in which the land is located. The circuit court shall try
the appeal as an action not triable by right to a jury. If appeal is not taken
or if it results, upon trial, in an affirmance of the order of cancellation,
the order becomes absolute and the real property forfeited may be sold without
notice.
(3) In addition
to the remedy for breach or default of a land sale contract under this section,
a county may pursue any other remedy provided by law for breach or default of a
land sale contract including, but not limited to, the remedy provided by ORS 93.905
to 93.940.
(4) In case of
breach of condition or other default in performance of a purchase agreement
other than a land sale contract, a county may pursue any remedy provided by law
for breach or default of a purchase agreement other than a land sale contract. [Amended
