Statute Text
Civil
penalties.
(1) Any
person who violates any provision of ORS 274.040, 274.873 or 274.879, any rule,
order or lease adopted or issued under ORS 274.040, 274.873 or 274.876 or any
rule adopted under ORS 274.879 shall be subject to a civil penalty in an amount
to be determined by the Director of the Department of State Lands of not more
than $1,000 per day of violation.
(2) Civil
penalties under this section shall be imposed in the manner provided in ORS
183.745.
(3) The
provisions of this section are in addition to and not in lieu of any other
penalty or sanction provided by law.

penalty recovered under this section for violation of ORS 274.040, 274.873 or
