Formation, annexation or consolidation by resolution; contents of resolution.
(1) In addition to the initiation
of a peoples utility district formation, annexation or consolidation by
electors petition:
(a) Formation of
a district may be initiated by resolution of the governing body of each county
in which territory of the proposed district is situated or, if a city proposes
to create a district, by resolution of the city governing body;
(b) Annexation to
an existing district may be initiated by resolution of the board of directors
of that district; and
(c) Consolidation
of two or more districts may be initiated by resolution of the board of each of
the districts proposed to be consolidated.
(2) Resolutions
authorized under this section shall describe the boundaries of the affected
territory and, if for formation or consolidation of a district or districts,
the name by which the proposed district is to be known. [1979 c.558 §11; 2003
