Statute Text
Duties
of county clerk after recall election; official declaration of result of recall
election.
(1) In
the case of a recall election held on a date other than the date of the primary
election or general election, the county clerk shall prepare an abstract of the
votes and deliver it to the elections official authorized to order the recall
election not later than the 27th day after the election.
(2) Except as
provided in subsection (3) of this section, for purposes of Article II, section
18, of the Oregon Constitution, the result of the recall election referred to
in subsection (1) of this section shall be considered officially declared on
the date the abstract of the votes is delivered.
(3) If the
elections official authorized to order the recall election is the Secretary of
State, the Secretary of State shall officially declare the result of the
election not later than the 35th day after the election. [1999 c.318 §36; 2005
