Administering oaths; compelling attendance of witnesses and production of documents;
depositions of witnesses.
(1) In the course of an investigation, the commission may administer oaths,
subpoena witnesses and compel the production of books, papers, documents and
accounts pertinent to the investigation. Attendance of witnesses, either with
or without books, papers, documents or accounts, may not be compelled unless
such witnesses are personally served with subpoena.
(2) The
commission may cause the deposition of witnesses residing within or without the
state to be taken in the manner prescribed by law for like depositions in civil
suits and actions.
(3) If a person
refuses to attend to give testimony or produce books, papers, documents or
accounts, pursuant to a subpoena issued under this section, the circuit court
of the county in which the political subdivision is located, upon petition of
the commission, shall compel obedience to the subpoena and shall punish refusal
to obey or to testify in the same manner as a refusal to obey a subpoena or to
testify pursuant to a subpoena issued from the circuit court. [1959 c.252 §16]
