Duties
of garnishee created by challenge to garnishment.
(1) Upon receiving notice of a
challenge to a garnishment under ORS 18.702, a garnishee who would otherwise be
required to make a payment to the garnishor shall mail or deliver the payment,
by cash or by check made payable to the court, to the court administrator. The
garnishee must make the payment to the court within the time that the garnishee
would have otherwise been required to mail or deliver the payment to the
garnishor. A garnishee who fails to make payment in the manner required by this
section is subject to liability under the provisions of ORS 18.775 to 18.782.
(2) Upon
receiving notice of a challenge under ORS 18.702, a garnishee who holds any
property described in ORS 18.750 must hold the garnished property for the
period specified in ORS 18.752 (1). If the sheriff informs the garnishee before
the end of the period specified in ORS 18.752 (1) that the property held by the
garnishee will be sold, the garnishee shall continue to hold the property until
