Statute Text
Proceedings in absence of arrest under executive warrant within specified time.
If the accused is not arrested
under warrant of the Governor by the expiration of the time specified in the
warrant, security release or release agreement, the judge or magistrate may
discharge the accused or may recommit the accused to a further day, or may
again set a security release or a release agreement for the appearance and
surrender of the accused, as provided in ORS 133.809; and at the expiration of
the second period of commitment, or if the accused has been released and
appeared according to the terms of the security release or release agreement of
the accused, the judge or magistrate either may discharge the accused or may
require the accused to enter into a new security release or release agreement
to appear and surrender at another day. [Formerly 147.170]
