JUDICIAL DECISIONS Vehicle used for medical transport not motor carrier. - Survivors of a deceased patient could not bring a direct action against a transporting van's insurer under O.C.G.A. § 40-1-112(c) of the Georgia Motor Carriers Act because the van was exempt from the motor carrier definition under O.C.G.A. § 40-1- 100(12)(B)(vii): the van was used exclusively to transport individuals to receive medical care and was not capable of transporting more than 10 people, although the van had originally been designed to carry 12 people.
