JUDICIAL DECISIONS Duty of custodians. - Although the plain language of O.C.G.A. §§ 17-4-21 and 17-4-26 directs the "arresting" officer to bring the detainee before a judicial officer, but omits any similar directive for custodians or third party entities entrusted with incarcerating the arrestee, the court was unwilling to allow Burke County, Georgia, to hide behind a technicality.
