Number: Winter Garden 59 Police Department Rescinds: General Order SUBJECT: Law Enforcement Vehicle Operations EFFECTIVE: December 2, 2013 REVISED: November 1, 2017 Table of Contents: 59.1 Purpose 59.2 Policy 59.3 Authority 59.4 Definitions 59.5 Procedures 59.6 Response to Calls for Service 59.1 PURPOSE: This directive provides procedures for the operation of a law enforcement vehicle by a department member. 59.2 POLICY: All personnel operating emergency law enforcement vehicles shall exercise due regard for the safety of all persons and operate the vehicle in compliance with all applicable state traffic laws. 59.3 AUTHORITY: Section 316.072(5), Florida Statutes Florida Law Enforcement Driving Task Force Committee 59.4 DEFINITIONS: 59.4.1 Distracted Driving – Any activity that could divert a person’s attention away from the primary task of driving. All distractions endanger driver, passenger, and bystander safety. These types of distractions include texting, using a cell phone or smartphone, eating and drinking, using a navigation system, viewing and/or typing on a laptop, or reading while driving. 59.4.2 Due Regard – When a reasonably careful person, performing similar duties under similar circumstances, would act in the same manner. 59.4.3 Emergency – A situation in which there is a high probability of death or serious bodily injury to an individual or significant property loss. 59.4.4 Officer – Any sworn law enforcement agent who has the authority to arrest.
