POLICY
159.0FRAUD/CREDIT CARD

A.The fraudulent use of a credit card $300.00 or more is a felony. Theft can also be
charged.
B.If the credit card receipt is signed by a person other than the credit card holder or other
authorized person, forgery can be charged.
C.VERIFY WITH CREDIT CARD COMPANY THE STATUS OF THE ACCOUNT
1.Lost or stolen card report establishes probable cause.
2.Overdrawn or defaulted credit cards are civil matters.
D.SUSPECT ON SCENE
1.Demand identification.
2.Obtain suspect's story or alibi.
3.Verify with credit card company status of account.
4.Arrest when probable cause is established.
5.Advise credit card center of arrest and future need of forgery affidavit.
6.Instruct company representative to sign affidavit portion of report.
7.Confiscate original credit card and receipts, and protect for latent processing.
E.Possession of two or more credit cards in different names, with criminal intent,
establishes probable cause for felony arrest, (FSS 817(S)).
F.Notify the Chief of Police or his/her designee of all felony arrests so that proper follow-
up can be initiated as soon as possible.
G.Notify victims and witnesses of the need for affidavits or statements in felony arrest
cases. A sworn affidavit form shall be filled out and signed by the victim. Special efforts
should be made to inform out-of-town victims and witnesses to contact the Officer prior
to the 21-day case filing deadline.
