130.0OFF-DUTY EMPLOYMENT

Off-duty employment or assignments are uniform assignments that are outside of the
regular duty hours and assignments or entity employing the El Portal Police Department
employee.
Off-duty does not include any assignment where the employee is paid by the Village of
El Portal. (I.e.-overtime details)
Off-duty employment may be granted to any police officer, subject to the following;
Regular full-time police officers have preference in the selection of off-duty assignment
and hours.
Part-time officers may accept any off-duty jobs not already taken by full-time
personnel.
Police officers while on FTO assignment may not work off-duty jobs.
Engaging in off-duty employment is a privilege granted by the Chief of Police, and as
such is subject to termination or discontinuance, modification, reduction, or changes as
he deems appropriate. Off-duty employment is limited to the jurisdictional boundaries of
the Village of El Portal except as provided;
Officers may work off-duty assignments outside the Village of El Portal, at the request of
another law enforcement agency, if the agency requires additional manpower for large
events, or if the law enforcement agency is providing the pay, with the prior approval of
the Chief of Police.
Officers working off-duty assignments shall be in full police Class A or Class B uniform
at all times. Officers are required to abide by all Department rules, policies, procedures
and directives at all times while engaging in off-duty work or assignment.
OFF DUTY COORDINATOR (ODC)
The Chief of Police shall appoint an employee of the Department as the Off-duty
Coordinator, or ODC. The ODC has overall responsibility for administering all aspects
of off-duty work, except for the supervision of employees.

The position of ODC is not a promotion and subject to re-assignment by the Chief of
Police at any time.
All requests for Off-duty employment shall be directed to the ODC. If the request is for
an immediate assignment and the ODC is not working he or she should be contacted by
phone immediately.
The ODC is responsible for ensuring fair distribution of all off-duty work that comes to
his/her attention.
Assignments for all off-duty will be distributed so that all full-time officers shall have the
opportunity to work. Employee becomes available for assignment through a seniority
rotational list and days off. If there are multiple job assignments then senior officer shall
have the first pick of a day and then down the rotational seniority list. As an employee
declines an off-duty day, the individual drops to the bottom of the list and the next
employee advance to the top of list. This procedure is repeated until every individual on
the list accepts of declines a job assignment before becoming eligible to be considered a
second time. Officers are not permitted to use vacation, comp. time, holiday leave and/or
sick time to be able to work an off-duty job.
HOURS AND ATTENDANCE
Off duty employment hours shall not exceed 24 hours per calendar week.
All employment, including duty hours, off-duty and outside employment, shall not
exceed 64 hours per calendar week.
Any officer that has been scheduled to work an off-duty assignment, and is either
unavailable or unwilling to work the assignment, shall be responsible for obtaining a
replacement officer as soon as possible and required to notify his/her immediate
supervisor.
Officer who do not honor their obligation to work an assignment as scheduled, may be
removed from future consideration for any off-duty assignments, at the discretion of the
ODC. Any appeals may be directed to the Chief of Police.
SUSPENSION OR REMOVAL
Off-duty employment, jobs or assignment are automatically suspended under any of the
following conditions or circumstance;
Relieved of duty, with or without pay;
While or light duty or non-duty status;
While or a leave of absence;
While or paid or unpaid sick leave;
Failure to maintain any required CJSTC certificate of minimum standards;
Conflict with mandatory Department training or special operations

PROHIBITED ASSIGNMENTS
Any business where nudity or pornography occurs;
Any vehicular escorts with police vehicle, except those permitted by FDOT for
oversized vehicles and other specifically authorized by the Chief of Police.
Any person, firm, business or entity of questionable integrity or repute, or which is
suspected of being involved in prostitution, illegal gambling, or narcotics.
