POLICY 120.0LAW ENFORCEMENT MUTUAL AID AGREEMENT REVISED: 11 /2011 Revised: 4/2019RELATED POLICIES: Reviewed and Revised by Chief David Magnusson 4/2019 A.PURPOSE The purpose of this policy is to direct Members of the Department when taking law enforcement actions outside the jurisdiction of the El Portal Police Department. B.ON-DUTY Any on-duty El Portal Police Officer outside his/her jurisdiction may take law enforcement action consistent with the terms and conditions of the Mutual Aid Agreement when requested by another agency via Dispatch reference assistance. C.OFF-DUTY 1.Any officer while off-duty and within participating mutual aid municipalities may take law enforcement action under the following circumstances: a.IF REQUESTED to assist an on-duty officer in his/her jurisdiction. b.If the officer is a witness to a felony, which involves the use of force or the imminent threat of force against a citizen and immediate action is necessary to prevent injury to the citizen or escape by the perpetrator. 2.No one will take law enforcement action after having consumed an alcoholic beverage unless an officer and/or citizen’s life was in peril and non-action could result in their serious life-threatening injury or death; AND the amount of alcohol that was consumed would remain under the legal limit had they been driving. 3.In these circumstances the off-duty officer may revert to on-duty status and will operate under the terms and conditions of the mutual aid pact. It is the responsibility of the off-duty officer who reverts to on-duty status to exercise sound tactics and not jeopardize the safety of citizens or officers of the jurisdiction he/she is in. 4.It is the policy of the El Portal Police Department that the El Portal Police Officer, whenever possible, report the incident he/she views to the proper agency prior to taking action and render assistance as requested. Page 1 of 2 D.Should a El Portal Police Officer affect an arrest, notification will be made as soon as possible to the law enforcement agency with jurisdiction and any enforcement action will be coordinated with them. The officer will cooperate with the agency having jurisdiction and turn the arrested person over to them. If the other jurisdiction refuses, the El Portal Police Officer will arrange transportation of the prisoner to the Miami Dade County Jail where the prisoner will be booked. E.In every instance and as soon as practical, the El Portal Police Officer will notify an on- duty El Portal Police Supervisor and complete a El Portal police report. F.The Village and the Office of the Chief will maintain an up to date version of the Mutual Aid Agreement with each participating agency. Page 2 of 2
