POLICY 117.0FIREARMS QUALIFICATION, REGISTRATION AND INSPECTION REVISED: 11 /2011 Revised: 4/2019RELATED POLICIES: Reviewed and Revised by Chief David Magnusson 4/2019 A.POLICY It is the Policy of the El Portal Police Department that all Personnel authorized to carry firearms are trained and demonstrate proficiency in the use of each firearm prior to carrying and utilizing such firearm in the performance of their duties. B.PURPOSE Every Police Officer and Part-time Officer of the El Portal Police Department is expected to be proficient in the use, care and handling of any firearm carried as an on duty, secondary, off duty, special assignment or special purpose tactical weapon. The proficiency of an officer will be measured through the use of firearms qualifications, as set forth in this Policy. C.QUALIFICATION: 1.Requirements for firearms qualifications are as follows: a.All sworn officers will qualify once every twelve (12) months with their duty weapon and any secondary duty weapon, no less than once every twelve (12) months. b.All sworn officers will attend a shotgun familiarization course no less than once every twelve (12) months, if they want to carry a shotgun. c.Sworn officers must qualify no less than once every twelve (12) months with all off duty, special assignment or special purpose tactical firearms they desire and are authorized to carry. d.Nothing in this Policy shall preclude the Department from requiring an officer to demonstrate proficiency with a firearm more often than once every twelve (12) months. 2.An officer shall meet the firearm standards set by the Chief of Police and/or his/her designee before they are authorized to carry any firearms. a.The Chief of Police or his/her designee will maintain a current list of officers who have attended the Firearms Course, along with a list of each firearm an officer has demonstrated proficiency with. Page 1 of 3 b.The Chief of Police or his/her designee will maintain a current list of officers authorized to carry shotguns. 3.Should an officer fail to meet the firearms standard set by the Chief of Police and/or his/her designee during a qualification course, the officer will not be allowed to carry a firearm and go back on duty. The Sergeant will, within one week, offer a four-hour remedial training class; and the officer will then be given another opportunity to qualify. If the officer fails to qualify he/she will not be allowed to carry a firearm on duty until such time he/she can shoot a qualifying score. 4.An officer, who has been removed from duty as a result of a failure to qualify, will be assigned to an administrative duty position. This will not be a permanent The affected officer shall have three separate attempts to qualify after a remedial session with each failing attempt. If after three failed attempts to qualify with their service weapon, the officer will be recommended for temination 5.Dress For Duty Weapons Qualifications:. a.When not in uniform, officers will wear casual clothing, nonrestrictive pants with pockets and closed toe shoes. b.Officers' equipment shall consist of the weapon and duty gear they wear while on duty, along with loading devices. D.REGISTRATION 1.All duty, secondary, off duty, special assignment and special purpose tactical firearms which the officer desires and is authorized to carry under the provisions of this Policy, will be registered with the Chief of Police and/or his/her designee . 2.Any exchange, sale, or loss of a registered firearm will be recorded with the Chief of Police and/or his/her designee. E.INSPECTION 1.The Range Master may inspect all firearms for safety that the officer takes to the Range for qualification purposes. 2.A supervisor may, and is encouraged, at any time, to inspect any firearm carried for use by a subordinate officer. 3.In the event that a supervisor/firearms instructor believes any firearm to be functionally questionable, a report will be forwarded to the Chief of Police and/or his/her designee, who will inspect the firearm as soon as practical. In the interim, a loaner weapon if available will be issued to the officer or the officer may carry another personally owned and approved firearm that he/she has qualified with during the past 12 months. 114.2 - Page 2 of 3 4.If an officer's weapon is found functionally unserviceable, he/she can draw a weapon of the same model from the loaner weapon locker if available or use another personally owned, Department approved firearm that he/she has qualified with during the past twelve months. 5.If the Chief of Police and/or his/her designee finds a weapon dysfunctional, the officer owning the weapon will immediately notify his/her supervisor prior to their return to duty. The supervisor can then authorize a loaner weapon as necessary. The dysfunctional weapon must be re-inspected after repairs, prior to the officer using the weapon for duty purposes, by the Range Master. F. MAINTAINING RECORDS The Chief of Police and/or his/her designee will maintain records of the specific firearms that each El Portal Police Officer and Part-time Officer is qualified to carry, and also of the safety inspections upon these firearms.
