The efficient processing of these SAKS serves to honor the victims of these offenses and enhance our ability to bring their offenders to justice. Toward this end, the law enforcement agencies that investigate these crimes ("investigating LEAS") commit to the following: As of the effective date of this Memorandum of Agreement, investigating LEAs will submit SAKs to the Ventura County Sheriff's Office Crime Lab ("Crime Lab") for testing within 20 days after the SAK is collected. SAKS will be submitted to the Crime Lab according to these guidelines regardless of whether the victim chooses to cooperate with law enforcement's investigation. Accordingly, SAKs collected following an "abbreviated" medical evidentiary examination pursuant to Penal Code section 13823.95(b)(1) will be submitted to the Crime Lab as outlined above. • The only SAKs that investigating LEAs will not submit to the Crime Lab are those where the investigating LEA determines within 20 days that the allegation of a sexual assault was false. If an investigating LEA submits a SAK to the Crime Lab and later determines the allegation of a sexual assault was false, the investigating LEA will notify the Crime Lab's Combined DNA Index System ("CODIS") administrator of that determination. The Crime Lab commits to the following: All SAKS received from investigating LEAs will be initially processed for the presence of DNA evidence within 120 days of receipt, and any qualifying offender DNA profiles will be uploaded to CODIS. We, the undersigned, as authorized representatives of the Ventura County Sheriff's Office, the Ventura County District Attorney's Office, the Oxnard Police Department, the Port Hueneme Police Department, the Santa Paula Police Department, the Simi Valley Police Department, and the Ventura Police Department do hereby approve this document.
