University of California, San Francisco Police Department General Orders 3.43 Internal Affairs Investigations 3.43.5 Evidence Collection (Revised: 6/16/23 ) Evidence collection for Internal Affairs investigations involving Police Department personnel will be conducted in accordance with these guidelines: A. Criminal Investigation Evidence collection in a criminal investigation shall be consistent with the rules and/or procedures outline in the California Evidence Code, California Constitution and the United States Constitution. B. Serious Non -criminal Misconduct Investigation Personnel may be required to submit to evidence collection in serious non -criminal misconduct investigations when there are reasonable grounds to believe such procedures are necessary to complete the investigat ion: 1. Visual, field sobriety and blood alcohol/urine tests for on duty use of alcohol or illegal drugs/controlled substances. 2. For the protection of the officer(s) and the Police Department, in investigation of shooting incidents, the offic er(s) who us ed their firearm(s) will be required to submit to a blood and/or urine test within one hour of or as soon as practical after the incident to deter mine any use of alcohol or non -prescribed drugs. The results of the test will be sealed until the criminal investigat ion, if any, is completed so as not to jeopardize the criminal investigation and still collect the evidence for the administrative investigation. 3. Submit photo graphs or participate in a line -up. 4. Provide financial disclosure statemen ts (except sworn personnel). 5. Submit to medical and /or psychological fitness for duty when the examination(s) related directly to the alleged policy/procedure violations or under court order. a. Mandatory medical and/or psychological examinations will b e at the Police Department’s expense. b. Mandatory medical and/or psychological examinations will be conducted by a qualified person of the Police Department’s choosing. 6. Other reasonable investigative tools. C. Additional Witnesses Investigators shou ld make every reasonable effort to obtain the name, address and telephone number of additional witnesses.
