University of California, San Francisco Police Department General Orders 1 3.8 Compensation, Benefits and Conditions of Work: Benefits 3.8.15 Retired Officer Identification Cards (Revised: 9/27/23) The purpose of this general order is to establish a consistent policy and procedure regarding the issuance and revocation of ID cards and carry concealed weapons (CCW) endorsements and certifications for retired officers of the UCSF Police Department , including recognition of the “Law Enforcement Officers Safety Act of 2004” (“LEOSA”) , Title 18 United States C ode (USC) §§ 926B and 926C and the California Penal Code (PC) . A. Definitions 1. Honorably Retired : Refers to peace officers who have service retired and entered retirement status directly from active service as a peace officer or who have not agreed to a service retirement in lieu of termination (PC § 16690 ). a. Officers receiving duty disability income have not separated from the UC and are not retired. 2. Retirement in Lieu of Termination : For purposes of determining eligibility for retiree privileges, a retirement occurs in lieu of termination when a formal agreement to avoid termination was made or retirement occurs immediately follow ing service of notice of adverse action recommending termination. 3. Good Cause : An appealable basis for denial or revocation of CCW privileges. Good cause may be based on misconduct o r any factor that could jeopardize public safety. 4. Good Standing : Refers to peace officers who have either service retired or retired due to a disability and who did not retire in lieu of termination or while under investigation for circumstances that could warrant termination. 5. Qualified Retired Peace Officer : For the purposes of CCW issuance or endorsement, a Qualified Retired Peace Officer is a retire d officer who meets all of the following criteria: a. At the time of retirement, the officer was a full time , sworn employee o f the UCPD who was authorized to and did carry a firearm during the course and scope of his/her employment b. The officer honorably retired from the UC, directly from active service as a peace officer and is receiving or is immediately eligible to receive benefits under the provisions of the UC Retirement System c. The officer did not retire due to a psychological disability [PC § 26305 (a)] and ha d no me ntal health incapacity limiting his/her ability to work as a sworn police officer preceding his/her retirement in good standing d. The officer is not otherwise subject to a lawful restriction on the possession of firearms that would conflict with CCW endor sement e. The officer meets the UCSF Police Departmen t’s firearm proficiency qualification standard. University of California, San Francisco Police Department General Orders 2 B. The Department shall issue ID cards and CCW endorsements or certifications to its retired peace officers in accordance with PC §§ 16690, 25450, 25455, 25460, 25465, 25470, 25475 , 26300, 26305, 26312, 26315, 26320 and 26325 , Chapter 44, Title 18 USC § 926C (the “Law Enforcement Officers Safety Act of 2004”) and all other applicable laws and policies. C. Carry Concealed Weapons Privilege 1. Upon or after retirement, honorably retired peace officers seeking CCW privilege within the jurisdiction of the State of California shall be issued an ID card with such an endorsement by the UCSF Police Department only if they are a Qualified Retired Peace Officer, as described in Section A of this General Order (PC §§ 25450 and 25455) . 2. Any peace officer who retired before January 1, 1981 shall not be required to obtain an endorsement from the issuing agency in order to carry a concealed firearm (PC § 25455). 3. Honorably retired peace officers who retired before January 1, 1981 and whose CCW privilege has been denied shall be issued ID cards stamped with the text “Not CCW Approved.” Cards of this type have no expiration date and otherwise resemble tho se described in Section E of this General Order (PC § 25470) . 4. Honorably retired peace officers who retired on or after January 1, 1981 and who have not been denied CCW privilege shall be issued ID cards stamped with the text “CCW Approved” [PC § 25460 (c )]. 5. Honorably retired peace officers who elect to and are approved to carry concealed weapons shall remain in the California Department of Justice (DOJ) Summary Criminal History Information Database, pursuant to PC § 11105 (k)(1). D. National CCW Privilege Upon or after retirement, UCPD peace officers seeking an endorsement of national CCW pursuant to the Law Enforcement Officer Safety Act “LEOSA,” in addition to California CCW privilege, shall be issued an ID card with such an endorsement if the f ollowing conditions are met: 1. The officer is a Qualified Retired Peace Officer who retired in good standing from sworn service at the UCPD 2. Before retirement, the officer was regularly employed as a law enforcement officer for an aggregate ten years o r more or retired, after completing any probationary period, due to a service -connected disability (18 USC § 926C) 3.
