CATEGORY DATE ADOPTED LAST REVIEW 3 01/24/2011 06/01/201 6 TUSTIN POLICE DEPARTMENT STANDARD OPERATING PROCEDURES SS702 – Property Retained for Department Use 1 SS70 2 PROPERTY RETAINED FOR DEPARTMENT USE SS.702.1 PURPOSE AND SCOPE The purpose of this procedure is to describe the process for the retention of a weapon , firearm or other property which has been designated for destruction for departmental and/or education al program use. SS.702.1.2 ACCREDITATION STANDARDS This procedure pertains to the following CALEA Standards : 84.1.4 This p rocedure pertains to the following General Orders: §804 SS.702.2 PROCEDURE The Gang Unit Supervisor or hi s/her designee , or a department Rangemaster , may request certain weapons designated for destruction to be retained for department use , or to be disp layed in the Gang Unit Display Box for educational purposes. California Penal Code 12030(b) clearly states, “Any law enforcement agency which has custody of any firearms, or any parts of any firearms, which are subject to destruction as required by this chapter may, in lieu of destroying the weapons, retain and use any of them as may be useful in carrying out the official duties of the agency.” The Gang Unit Supervisor or Rangemaster may request the Property & Evidence Unit retain a particular weapon fo r departmental use or display purposes. The S upervisor or Rangemaster will prepare a memo to the Division Commander with over site of the Firearms Training Unit for approval and authorizing signature describing the weapon to be retained and the reason for retention . Once approved, the Property & Evidence Supervisor and/or Technician will go into UPROP and update the location of the weapon in the Records Management System. An additional entry will be made in the Automated Firearms System (AFS) , by the Record s Unit, listing the weapon as an Institutional Firearm. Weapons retained for instructional or display use will be disable d by a department armorer prior to being put in the Gang Unit Display Box or used in any other educational display . When the weapon is no longer needed for department use , it will be destroyed and the appropriate RMS and AFS notifications will be made. All original documentation related to the retained weapon and/or ultimate destruction must be scanned into Laserfic he and then filed in the original CR# report file located in Records. A copy of all documentation is kept in the Property & Evidence Unit in the weapons retention binder. CATEGORY DATE ADOPTED LAST REVIEW 3 01/24/2011 06/01/201 6 TUSTIN POLICE DEPARTMENT STANDARD OPERATING PROCEDURES SS702 – Property Retained for Department Use 2 A detective from another unit (General Investigations, Special Investigations, SED or Gangs) may request certain property designated for destruction be retained for department use, with the written approval of the Unit Supervisor, or his/her designee. An Authorization for Disposal or Release of Property form must be completed and the ap propriate box under the heading, Retention of Property shall be checked. A notation shall be made on the form as to which unit is receiving the property and a signature obtained from the receiving party. The Property and Evidence Specialist shall update the Records Management System (RMS) to reflect the new location.
