CATEGORY DATE ADOPTED LAST REVIEW 3 01/24/2011 06/01/201 9 TUSTIN POLICE DEPARTMENT STANDARD OPERATING PROCEDURES CP406 - Administrative Citation Process 1 CP406 ADMINISTRATIVE CITATION PROCESS CP406.1 PURPOSE AND SCOPE This procedure outlines the guidelines for issuance of Tustin Administrative Citations. CP406.1.2 ACCREDITATION STANDARDS This procedure pertains to the following CALEA standards: 1.2.6 , 44.2.1, 61.1.2, 82.2.2 This procedure pertains to the following General Orders: N/A CP406.2 PURPOSE OF CITATION An administrative citation is an alternative method of enforcement for various violations of the Tustin City Code. The goal is to reduce the burden on the judicial system while providing full due process for those cited . In addition, administrati ve citations and monetary penalties are imposed to encourage an d expedite compliance with provision s of the Tustin City Code. The procedures established are in addition to criminal , civil, or other legal remedies that may be available to the City to enforce violations of the Tustin City Code or applicable State Code s. Citizen arrests for TCC’s , or violations an officer feels would be better served criminally , should be handled in accordance with current policy. The violator should be cited in accordance with TPD Policy §420 to the Superior Court of California, County of Orange, Central Justice Center, 700 Civic Center Drive West, Santa Ana, CA 92701. CP406.2.1 AUTHORITY AND FINES Any person violating any provision of the Tustin City Code may be issued an administrative citation by an authorized Enforcement Officer . Pursuant to Tustin City Code 1132, authorized Enforcement Officer includes a sworn police officer, or other Police Deaprtment employees designated by the Chief of Police . A violation of this Code includes, but is not limited to, all violations o f the Tustin City Code, the Uniform Codes ado pted by the City Council, or the failure to comply with any condition imposed by any entitlement, permit, agreement, or environmental document issued or approved pursuant to this Code. Each and every day a violation of the Tustin City Code exists constitutes a separate and distinct offense. CATEGORY DATE ADOPTED LAST REVIEW 3 01/24/2011 06/01/201 9 TUSTIN POLICE DEPARTMENT STANDARD OPERATING PROCEDURES CP406 - Administrative Citation Process 2 Fines shall be assessed in the amounts specified by resolution of the City Council (Ordinance No. 1358) , or where no amount is specifie d: a) A fine not exceeding one hundred dollars ($100.00) for a first violation; b) A fine not exceeding two hundred dollars ($200.00) for a second violation of the same ordinance or permit within one (1) year from the date of the first violation; c) A fine not exc eeding five hundred dollars ($500.00) for a third or more violation of the same ordinance or permit within one (1) year from the date of the first violation. CP406.3 CITATION PROCEDURE An administrative citation can be issued in person, certified mail, or by posting it on -site. The following procedure is used when : Issuing the citation in person: a) Obtain the responsible persons ’ identification ; b) Complete the citation ; c) Have the responsible person sign and date the citation . Failure or refusal to sign shall not affect the validity of the citation ; d) Keep the white copy of the citation and give the yellow copy with the attached en velope to the responsible party; e) Scan a copy to PDF format and e -mail it to Turbo Data (ci tations@turbodata.com) , Assistant Community Development Director , Dana Ogdon (Dogdon@tustinca.org) and Doug Amos (Doug@turbodata.com); f) Make one photocopy of the citation ; g) Keep the copy of the citation, with any backup documentation that m ay be use d in an appeal, for their files; h) Send the original white citation to Assistant Community Development Director, Dana Ogdon in an inter -department routing envelope. Serving citation by mail: a) Comple te the citation ; b) Scan a copy to PDF format and e -mail it to Turbo D ata (citations@turbodata.com) and Assistant Community Development Director, Dana Ogdon (dogdon@tustinca.org) ; c) Make two photocopies of the citation to include both sides of the citation; d) Send the yellow citation copy with the attached envelope by certified mail to the responsible person ; e) Send one photocopy of the two -sided citation first class mail to the responsible party ; f) Keep one of the copies of the citation, along with any backup documentation that may be used in an appeal, for their files; g) Send the ori ginal white citation to Assistant Community Development Director Dana Ogdon in an inter -department routing envelope.
