CATEGORY DATE ADOPTED LAST REVIEW NEXT REVIEW 2 01/24/2011 06/01/201 9 06/01/20 20 TUSTIN POLICE DEPARTMENT GENERAL ORDERS ______ ______________________ 1054 - Modified Duty Assignments 1 POLICY 1054 MODIFIED DUTY ASSIGNMENTS 1054.1 PURPOSE AND SCOPE The purpose of this policy is to establish procedures for assigning employees to modified duty. The City’s modified duty program is also outlined in the Personnel Rules, Section 8, G1(d). Where a conflict exists between items stated in a provision of this policy and the City’s Personnel Rules, The Personnel Rules shall prevail. Temporary modified duty assignments may be available to employees who have incurred a duty -related illness or injury and, due to restrictions or limitations, are unable to perform their regular assigned duties. Non -duty related illnesses or injuries may also be considered fo r eligibility in accordance with this policy. Eligibility for modified duty assignments is subject to the approval of the Chief of Police or his/her designee and the City Human Resources Department . Modified duty assignments are intended to provide an employee with the ability to continue working within the limits of his/her restrictions and limitations on a temporary basis while providing the Department with a productive employee during the interim period. The department, in conjunction with the City Human Resources Department, will engage in a good faith interactive process to consider reasonable accommodations for any employee with a temporary or permanent disability. 1054.1.1 ACCREDITATION STANDARDS This section pertains to the following CALEA St andards: 22.2.2, 22.2.4, 22.3.2 This policy pertains to the following Standard Operating Procedures: N/A 1054.1.2 DEFINITION Modified Duty – A temporary, limited -term assignment not requiring performance of the full range of duties associated with the regular job classification. Modified duty may also be termed as light duty assignments. 1054.2 LIMITATIONS Modified duty assignments are a management prerogative and not an employee right. Modified duty assignments shall be subject to continuous reassessment dependent upon department need and the employee’s ability to perform in a modified duty capacity. An injured employee may be offered a modified duty position outside of his/her normal assignment or duties if it becomes available . a) If an emplo yee cannot adequately perform in a modified duty assignment, such assignmen t may be modified or terminated; b) The lack of Department need or a change in priorities may result in the employee’s removal from or modificatio n of a modified duty assignment; CATEGORY DATE ADOPTED LAST REVIEW NEXT REVIEW 2 01/24/2011 06/01/201 9 06/01/20 20 TUSTIN POLICE DEPARTMENT GENERAL ORDERS ______ ______________________ 1054 - Modified Duty Assignments 2 c) The department may place conditions as deemed appropriate upon any modified duty assignment. 1054.2.1 SUPERV ISION OF MODIFIED DUTY EMPLOYEES In the case where an employee’s modified duty assignment places him/her in a position outside of his/her regularly as signed cha in of command, the immediate supervisor for the modified duty assignment position will become the employee’s immediate supervisor for the term of the modified duty assignment. The employee should make ever y reasonable effort to keep the modified duty assignment supervisor and his/her regular duty assignment supervisor appraised of his/her duty status. 1054.3 PROCEDURE Employees may request assignment to modified duty by providing a signed statement from his/her health care provider describing his/her restrictions, limitations, and expected duration to the Professional Standards Division Commander , or his/her designee. The statement must also indicate if the employee requires any workplace accommodations, mobility aids, or medical devices. The Professional Standards Division Commander , in conjunction with the City Human Resources Department, will determine what modified duty assignments may be available based on the needs of the department, limitations of the employee, and suitability of the emp loyee to work a particular assignment. 1054.3.1 MODIFIED DUTY SCHEDULES The schedules of employees assigned to modified duty may be adjusted to suit Department needs at the discretion of a Division Commander. The employee and his/her supervisors should be informed in writing of the schedule, assignment, and limitations and restrictions as determined by the employee’s health care provider. 1054.3.2 ACCOUNTABILITY The employee’s supervisor shall coordinate efforts to ensure proper time accountabil ity through the Intime Scheduling Engine (ISE) and shall prompt the completion of a Personnel Action Form (PAF) if appropriate . a) An e mployee on modified duty as a result of an on -duty injury, is responsible for coordinating required doctor visits and physical therapy appointments in advance with his/her supervisor to appropriately account for any duty time taken. Doctor visits and appointments for treatment of injuries or illnesses that are not work related shall be arranged during off -duty time or ot herwise charged to an employee’s general leave; b) An e mployee shall promptly submit a status report for each visit to his/her treating health care prov ider and shall immediately notify his/her supervisor of any change in restrictions or limitations as determined by his/her health care provider; CATEGORY DATE ADOPTED LAST REVIEW NEXT REVIEW 2
