CATEGORY DATE ADOPTED LAST REVIEW 1 01/24/2011 05/01/20 21 TUSTIN POLICE DEPARTMENT GENERAL ORDERS ______________________ 900 - Temporary Holding Facility 1 POLICY 900 TEMPORARY HOLDING FACILITY 900.1 PURPOSE AND SCOPE This policy establishes guidelines for the booking, housing, security and release of arrestees at the Tustin Police Department’s Temporary Holding Facility. In addition to this policy, the Department shall maintain the Tustin Police Department Temporary Holding Facility Procedures Manual on a current basis to reflect the procedures being followed within the Temporary Holding Facility ( Title 15 § 1029 California Code of Regulations (CCR) ). The policies of the Temporary Holding Facility also include the following Policy Manual sections: • Policy Manual § 300 Use of Force • Policy Manual § 306 Leg Restraint Device • Policy Manual § 308 Control Devices and Techniques • Policy Manual § 324 Minors • Policy Manual § 418 Mental Illness Commitments • Policy Manual § 420 Cite and Release Policy • Policy Manual § 422 Arrest and Detention of Foreign Nationals • Policy Manual § 428 Immigration Violations • Policy Manual § 514 Drunk Driving Evidence and Collection • Policy M anual § 902 Custody Searches • Policy Manual § 1016 Communicable Diseases The Department shall maintain the custody of arrestees in accordance with this policy, the Tustin Police Department Temporary Holding Facility Procedures Manual and the laws as establ ished by the Correctional Standards Authority. 900.1.1 ACCREDITATION STANDARDS This section pertains to the following CALEA Standards: 1.2.3 , 1.2.5 , 41.2.4 , 42.2.8 , 46.1.2 , 46.1.4 , 70.1.6 , 70.5.1 , 71.1.1 , 71.2.1 , 71.3.1 , 71.3.2 , 71.3.3 , 71.4.1 , 71.4.2 , 71.4.3 This section pertains to the following Standard Operating Procedures: N/A 900.2 FACILITY ADMINISTRATION 900.2.1 ADMINISTRATIVE PERSONNEL AND RESPONSIBILITIES The following responsibilities for the Temporary Holding Facility operations have be en established (15 CCR § 1029) : a) Facility Administrator : The Chief of Police shall be the facility administrator officially charged, by law, with the administration of the Temporary Holding Facility; CATEGORY DATE ADOPTED LAST REVIEW 1 01/24/2011 05/01/20 21 TUSTIN POLICE DEPARTMENT GENERAL ORDERS ______________________ 900 - Temporary Holding Facility 2 b) Temporary Holding Facility Manager : The Field Support Division Manager will have the responsibility for planning, managing, administrative functions, review of the facility manual, and the operations of the Temporary Holding Facility; c) Maintenance Manager : The PSO/CSI Supervisor will be responsible for the ph ysical maintenance, cleanliness and supply of the Temporary Holding Facility. The PSO/CSI Supervisor will be responsible to the Facility Manager; d) Temporary Holding Facility Supervisor : The employee with 24 -hour per day functional responsibility for the T emporary Holding Facility will be the Watch Commander. Any other Supervisor may provide assistance as needed; e) Custodial Personnel : Custodial personnel shall be those on -duty sergeants, officers, detectives , jailers , or other designated employees whose add itional duties include the supervision of arrestees that are detained in the Temporary Holding Facility; f) Arresting Officer Responsibility : The arresting officer shall conduct a pat -down search of an arrestee in the field to make sure that the person does not have any items that could inflict harm to the officer or other arrestees during the transport to the booking facility. The arresting officer is ultimately responsible for the processing and final disposition of their arrestee. g) Transporting Officer or Jailer Responsibility: The transporting officer or jailer shall conduct a pat -down search of an arrestee prior to transport to make sure that the person does not have any items that could inflict harm to the officer or other arrestees during the transport to the booking facility. The transporting officer will assist the arresting officer with processing the arrestee as requested and ensure the secur ity of the arrestee until relieved by the arresting officer or Watch Commander. 900.2.2 PHYSICAL FACILIT Y DEFINITIONS The following defines the Tustin Police Department Temporary Holding Facility and its physical attributes: a) Temporary Holding Facility : The secured area of the police structure designed for the temporary detention of arrestees prior to relea se on citation from on -site; or transfer and formal booking at a jail facility. The length of detention per policy will not exceed four (4) hours without supervisory approval. b) Sallyport: The gated area designed to allow officers to drive into prior to re moving arrestees from their vehicles. The area will accommodate three vehicles and provides a stationary security bench for arrestees to be handcuffed to.
