CATEGORY DATE ADOPTED LAST REVIEW 2 01/24/2011 05/25/2022 TUSTIN POLICE DEPARTMENT GENERAL ORDERS ___________ _____________________ 600 - Criminal Investigation Administration 1 POLICY 600 CRIMINAL INVESTIGATION ADMINISTRATION 600.1 PURPOSE AND SCOPE The purpose of this section is to create a framework for efficient and effective criminal investigations. Criminal investigations can be performed by both uniformed officers and detectives specialized in investigations. When assigned to a case for initial or follow -up investigation, detectives shall proceed with due diligence in evaluating and preparing the case for appropriate clearance or presentation to a prosecutor for filing of criminal charges. 600.1.1 ACCREDITATION STANDARDS This section pertains to the following CALEA Standards: 42.1.1, 42.1.2 , 42.1.3 , 42.1.4 , 42.1.5 , 42.2.2 , 42.2.3 , 42.2.7 , 42.2.9, 43.1.2 , 55.2.4 , 61.2.4, 82.3.5 This section pertains to the following Standard Operating Procedures: §SP100, §SP104 600.2 PRELIMINARY AND FOLLOW -UP INVESTIGATIONS Patrol officers and/or Police Services Officers (PSO’s) are the first responders and responsible for the preliminary investigation of crimes. Patrol officers o r PSO’s may conduct the follow -up investigation, if practicable, for cases they are assigned. Patrol officers responding to serious felonies should ask their supervisor if it is appropriate to request a detective be called out. If a patrol officer is unabl e to complete follow -up on a routine case, that case should be forwarded to detectives. The Criminal Investigations Unit conducts the follow -up investigation on serious and complex cases or those where the follow -up by patrol is not p racticable. Detectives will generally be requested to handle and respond to the following cases : a) Felony child abuse; b) Serious Sexual assaults; c) Suspicious deaths; d) Homicides; e) Critical At Risk Missing Person 600.2.1 CALL OUTS For the purposes of having a detective available at t imes other than normal business hours, the on-duty Watch Commander will make the decision to notify the appropriate Special Operations Division supervisor. Based on the crime, the Watch Commander will call the supervisor of the Criminal Investigations Unit, GRADE Unit, or Traffic Unit. The Watch Commander will brief the appropriate investigative supervisor and a decision to call out detectives will be made. The unit supervisor will decide which detective will be called out , based on the type of crime and res ources available. The on -duty Watch Commander or field supervisor will determine the need before calling the appropriate Special Operations Division supervisor. In determining when to call out a detective, CATEGORY DATE ADOPTED LAST REVIEW 2 01/24/2011 05/25/2022 TUSTIN POLICE DEPARTMENT GENERAL ORDERS ___________ _____________________ 600 - Criminal Investigation Administration 2 supervisors should consider the seriousness of the offense, complexity of the case or crime scene, staleness of the crime, and available manpower and their expertise. The appropriate Special Operations Division supervisor will immediatel y notify the Special Operations Division Commander then contact appropriate Investigations unit’s detectives of the call-out request. The appropriate Special Operations Division supervisor has the authority to authorize or deny a call -out response, unless directed by someone of higher rank. The appropriate Special Opera tions Division supervisor shall coordinate call -out requests of detectives assigned to Regional Narcotics Suppression Program (RNSP) and Orange County Auto Theft Task Force (OCATT) with the supervisors of those task forces. 600.2.2 RESPONSIBILITY AT CRIM E SCENES When a detective is summoned to a crime scene, the detective will confer with the patrol officer in charge. The detective will assume responsibility as the case agent and will have the authority to control the crime scene, direct the investigation , and direct those police resources at the scene. Detectives and patrol personnel shall endeavor to cooperate to the utmost level , having the solution of the crime and public safety foremost in mind. “Officer in charge ” refers to supervisory personnel or the assigned handling officer at the scene. If a commanding officer is present, the detective will be under the direction of the commanding officer. 600.3 FOLLOW -UP INVESTIGATION PROCEDURES Follow -up Investigation Procedures are developed and are maint ained in the Tustin Police Department Procedures Manual. Department members conducting follow -up investigations will follow the established procedures to minimally include (as appropriate ): a) Reviewing and analyzing all reports prepared in the preliminary p hase, departmental records, and results from laboratory examinations; b) Conducting additional interviews and interrogations; c) Seeking additional information from uniformed officers and/or informants; d) Planning, organizing, conducting searches, and collecting p hysical evidence; e) Identifying and apprehending suspects; f) Determining involvement of suspect in other crimes; g) Checking suspects’ criminal histories; h) Preparing cases for court presentation; i) Maintaining contact with principals in the investigation and others associated with the case. 600.3.1 CUSTODIAL INTERROGATION REQUIREMENTS
