CATEGORY DATE ADOPTED LAST REVIEW NEXT REVIEW 4 1/24/2011 08/01/201 8 08/01/2020 TUST IN POLICE DEPARTMENT GENERAL ORDERS _______________________ 524 - Parking Violations 1 POLICY 524 PARKING VIOLATIONS 524.1 PURPOSE AND SCOPE This policy provides procedures for the issuing of parking citations and the marking, recording, and storage of vehicles parked in violation of the Tustin City Ordinance regulating 72 -hour parking v iolations and abandoned vehicles under the authority of Vehicle Code §§ 22652.6 and 22669. 524.1.1 ACCREDITATION STANDARDS This section pertains to the following CALEA Standards: 61.1.12 , 61.1.13, 61.4.3 This section pertains to the following Standard Operating Procedures: N/A 524.2 PARKING ENFORCEMENT The Tustin Police Department enforces the California Vehicle Code and Tustin Municipal Code as related to parking violations. Citations are issued using the approved City of Tustin Parking Citation form , which is a three -part triplicate format allowing for officer notes on the back of the citation. When issued, the pink copy is left on the violating vehicle; and the white and yellow copies are turned into the Records Unit for processing. The white copy is fo rwarded to the contracted firm for parking citation processing . The yellow copy, including any officer notes or attached teletypes regarding violations, is retained in the parking citation file in the Records Unit until disposition of the citation is compl eted. Citations can also be issued via a handheld electronic ticket writer. These citations are printed via a Bluetooth printer and a copy left on the violator vehicle. The electronic record will be automatically uploaded to the contracted citation proces sing company . Any appeal to the parking citation process is handled per General Order §516.7 – Notice of Parking Violation Appeal Procedure. 524.3 ABANDONED VEHICLE / 72 HOUR VIOLATION ENFORCEMENT 524.3.1 MARKING VEHICLES Vehic les suspected of being abandoned and/or in violation of the City of Tustin 72 -Hour Parking Ordinance sh ould be marked and noted on the Tustin Police Department Marked Vehicle Card (TPD 3064) . No case number is required at this time. A visible chalk mark should be placed on the t ire unless missing tires or other vehicle conditions prevent marking. Any deviation in markings shall be noted on the TPD 3064. The investigating employee should make a good faith effort to notify the owner of any vehicle subject to towing prior to having the vehicle removed. This may be accomplished by personal contact, telephone , or by leaving notice attached to the vehicle , at least 24 hours prior to removal. If a marked vehicle has been moved, or the markings have been removed during a 72 -hour investigation period, the vehicle shall be marked again for the 72 -hour parking violation and a Marked Vehicle Card completed and forwarded to the Traffic Unit. Parking citations for the 72 -hour parking ordinance sh ould not be issued when the vehicle is stored for the 72 -hour parking violation. 524.3 .2 MARKED VEHICLE FILE The Traffic Unit shall be responsible for maintaining a file for all Tustin Police Departmen t forms 3064. Police Service s Officers , Parking Control Officers, and/or Cadets shall be responsible for the follow -up investigation of all 72 -hour parking violations noted on the Tustin Police Department form 3064. 524.3 .3 VEHICLE STORAGE Vehicle s in violation of the 72 hour parking ordinance should be stored by the authorized police towing service and a vehicle report shall be completed by the officer authorizing the storage of the vehicle. The vehicle report form shall be submitted to the Records Unit immediately following the storage of the vehicle. Records Unit staff shall immediately notify the Stolen Vehicle System of the Department of Justice in Sacramento (Vehicle Code § 22851.3(b) ). Notification may also be made to the National Law Enforcement Telecommunications System (Vehicle Code § 2854.5 ). Within 48 hours, excluding weekends and holidays, of the storage of any such vehicle, it shall be the responsibility of the Records Unit to determine the names and addresses of any individuals having an interest in the vehicle through DMV or CLETS computers. Notice to all such individuals shall be sent via U.S. Mail pursuant to Vehicle Code § 22851.3(d).
