CATEGORY DATE ADOPTED LAST REVIEW 1 05/16/2018 05/16/2018 TUSTIN POLICE DEPARTMENT GENERAL ORDERS 388 – Hospital Booking Process 1 388 HOSPITAL BOOKING PROCESS 388.1 PURPOSE AND SCOPE This procedure establishes guidelines set forth by the Orange County Sheriff’s Department as it pertains to hospital bookings. It outlines their department’s booking policy and procedure at the Inta ke Release Center (IRC) for hospital bookings. These policies and procedures are current and should be adhered to by outside agencies. 388.1.1 ACCREDITATION STANDARDS This policy pertains to the following CALEA Standards: 70.3.1 , 70.3.2 , 70.5.1 388.2 OBTAINING MEDICAL ATTENTION FOR ARRESTEES Arresting officers should arrange to obtain medical attention for arrestees with obvious medical conditions prior to bringing them to the Intake Release Center (IRC) for booking. In the event the arrestee is brought to the IRC, but refused for booking due to medical reasons, the arresting officer will need to take the arrestee to the hospital of our department’s choice to obtain medical treatment. If the arrestee cannot be medically cleared for booking and is admitted to the hospital, our department will need to either maintain physical custody of the arrestee until the arrestee is arraigned or obtain an Own Recognizance Release. Notify the IRC Receiving Guard Station Deputy at (714) 647 -6040 of your intent to have the arrestee remanded to the custody of OCSD 24 hours in advance if possible . This will help ensure OCSD has the personnel available when this transfer occurs later. It is imperative that the court liaison be notified as soon as practicable so they can start the notification process at the court level. If after hours, or on a weekend, please call the General Investigations Sergeant to initiate this process, and he/she will notify the c ourt liaison. 388.3 OBTAINING AN OWN RECOGNIZANCE RELEASE (OR) FOR ARRESTEES If the department wants to secure an OR release for an arrestee rather than maintain physical custody until the arraignment, a request must be made to the Detention Release Officer (DRO). Prior to calling the DRO, the officer should ha ve completed a Probable Cause Declaration and submitted it electronically through the PC Portal. If an arrestee is not released on his/her own recognizance and cannot be medically cleared for booking, the department will be required to have bail set prior to the arraignment, but preferably as soon as possible after admittance to the hospital. This is done by faxing a package consisting of the Probable Cause Declaration and the booking slip or arrest report face page to the DRO. The cover sheet for the fax package needs to clearly indicate that this is a hospital booking and include the officer’s name and phone number plus the hospital name and phone number. CATEGORY DATE ADOPTED LAST REVIEW 1 05/16/2018 05/16/2018 TUSTIN POLICE DEPARTMENT GENERAL ORDERS 388 – Hospital Booking Process 2 388.4 SUBMISSION OF PROBABLE CAUSE DECLARATIONS It is the responsibility of the Tustin Police Department to ensure that a Probable Cause Review is cond ucted by the court appointed Judicial Hearing Officer (JHO) within 36 hours (if booking into the IRC) or 48 hours (if maintaining custody at a city jail) beginning at the time of arrest. The important thing to remember is the clock does not stop just beca use the arrestee is in the hospital; the Probable Cause Review still needs to be done within the mandated period. You can fax to (714) 834 -5542. 388.5 REQUESTING AN EMERGENCY EXEMPTION TO THE OCSD HOSPITAL BOOKING POLICY In certain circumstances, emergency conditions could exist in Tustin’s jurisdiction making it difficult or impossible for us to maintain cust ody of a hospitalized arrestee, in addition to managing the emergency. In this type of situation, the Watch Commander shou ld contact the IRC Watch Commander at (714) 647 - 6015 and request assistance. If a mutual agreement can be reached, the IRC Watch Com mander will arrange for the Sheriff’s Department to take custody of the arrestee. This step should have already been evaluated and predicted based upon the severity of the medical condition and projected time of medical clearance. 388.6 THE ARRAIGNMENT PROCESS This process is typically conducted by our court liaison. The statutory time limit for having a suspect arraigned does not become extended merely because the suspect is in the hospital and cannot go to court. The suspect still needs to be arrai gned unless a judge finds cause to postpone the process.
