CATEGOR Y DATE ADOPTED LAST REVIEW 3 01/24/2011 08/01/201 8 TUSTIN POLICE DEPARTMENT GENERAL ORDERS _________________________________ 220 - Retired Officer CCW Endorsement 1 POLICY 220 RETIRED OFFICER CCW ENDORSEMENTS 220.1 PURPOSE AND SCOPE The purpose of this policy is to outline the process and conditions associated with the issuance, revocation and denial of concealed weapon s (CCW) endorsement for retired officers of this department. 220.1.1 ACCREDITATION STANDARDS This policy pertains to the following CALEA Standards: 1.3.10, 1.3.11 , 4.3.3 This policy pertains to the following Standard Operating Procedures: N/A 220.2 QUALIFIED RETIREES Any full -time sworn officer of this Department who was authorized to, and did, carry a concealed firearm during the course and scope of their employment shall be issued an identification card with a “CCW Approved” endorsement upon honorable retirement. (Penal Code § 25455 (a) and Penal Code § 26300 ). a) For the pur pose of this policy, “Honorably Retired” includes all peace officers who have qualified for, and accepted, a service or disability retirement; however, shall not include any officer who retires in lieu of termination or res igns and defers retirement benefits. b) No “CCW Approved” endorsement shall be issued to any officer retiring because of a psychological disability (Penal Code § 26305 (a) ). c) Identification cards with “No CCW” will be issued for a period of five years and it i s the responsibility of the retiree to petition the agency for re newal (Penal Code § 25465 ). 220.2.1 QUALIFIED RETIREES FROM OTHER AGENCIES The Tustin Police Department shall provide an identification card with a CCW Approved endorsement to honorably retired peace officers from any jurisdiction that this department now serves under the following conditions (Penal Code § 25905): a) The retiree's previous agency is no longer providing law enforcement services or the relevant government body is dissolved. b) This department is in possession of the retiree’s complete personnel records or can verify the retiree’s honorably retired status. c) The retiree is in compliance with all of the requirements of this department for the issuance of a CCW Approved endorsemen t. CATEGOR Y DATE ADOPTED LAST REVIEW 3 01/24/2011 08/01/201 8 TUSTIN POLICE DEPARTMENT GENERAL ORDERS _________________________________ 220 - Retired Officer CCW Endorsement 2 220.2.2 QUALIFIED RETIRED RESERVES Qualified retired reserve officers who meet the department requirements shall be provided an identification card with a CCW Approved endorsement (Penal Code § 26300). 220.3 MAINTAINING A CCW ENDORSEMENT In order to maintain a “CCW Approved” endorsement on an identification card, the retired officer shall: a) Qualify annually with the authorized firearm at a course approved by this Department at the retired officer’s expense (Penal Code § 25475 (a)) . Upon verifi cation by this Department that all annual requirements have been met by an otherwise qualified retired officer, the “CCW Approved” endorsement shall remain in effect. Failure to meet the annual qualification requirement will result in the “CCW Approved” en dorsement being revoked and a new “No CCW Privilege” identification card shall be issued. Identification cards issued in compliance with Penal Code § 25455 (a) shall be issued for a period of five years u nless the retiree elects to comply with the federal requirements outlined in Section 220.4. b) Remain subject to all department rules and policies as well as all federal, state and local laws. ( Penal Code § 26305 (b, c, & d) ). c) Only be authorized to car ry a concealed firearm inspected and approved by the Depa rtment; or approved by the Department and inspected by a certified armorer if located out of the area or out of state. 220.4 CARRYING FIREARMS OUT OF STATE Subject to 18 USC 926C and Policy Manual § 312.8, qualified retired officers of this Department may be authorized to carry a concealed weapon in other states, a) Retired officers must meet all of the standard s outlined in Sections 220.2 and 220.3. b) “CCW Approved” identification cards must be issued on an annual basis for compliance with 18 USC 926C. 220.5 IDENTIFICATION CARD FORMAT The identification card issued to any qualified and honorably retired officer shall be two inches by three inches and minimally contain the following ( Penal Code § 25460 (c)) : a) Photograph of the retiree ; b) Retiree’s name and date of birth ; c) Date of retirement ; d) Name and address of this department ; CATEGOR Y DATE ADOPTED LAST REVIEW 3 01/24/2011 08/01/201 8 TUSTIN POLICE DEPARTMENT GENERAL ORDERS _________________________________ 220 - Retired Officer CCW
