CATEGORY DATE ADOPTED LAST REVIEW NEXT REVIEW 2 07/07/2016 08/01/201 9 08/01/20 20 TUSTIN POLICE DEPARTMENT GENERAL ORDERS _________________ _________________ 219 – Personally Owned Rifles (POR) 1 POLICY 219 PERSONALLY OWNED RIFLES 219.1 PURPOSE AND SCOPE This policy establishes procedures for the acquisition, use and documentation of the use of Personally Owned Rifles (POR). The purpose of this policy is to provide swor n peace officers of the T ustin Police Department the ability to privately own and effectively train with the AR -15 rifle. 219.1.1 ACCREDITATION STANDARDS This policy pertains to the following CALEA Standards: 1.3.9, 1.3.10, 1.3.11 , 4.3.1 , 4.3.2 , 4.3.3 219.2 PERSONALLY OWNED RIFLE (POR) 219.2.1 DEFINITION A Personally Owned Rifle (POR) is an AR-15 rifle which is privately owned by a sworn peace officer of the Tustin Police Department for the purpose of training and self -defense. It is recognized that firearm proficiency is a perishable skill therefore the Personally Owned Rifle (POR) allows the officer to train off -duty. No personally owned rifles may be carried for patrol duty unless pre -approved in writing by the Chief of Police. Per California Penal Code § 30515, an assault rifle is a semiau tomatic, centerfire rifle that has the capacity to accept a detachable magazine and any of the following items: pistol grip that protrudes conspicuously beneath the action of the weapon, thumbhole stock, folding or telescoping stock, flash suppressor, forw ard pistol grip, magazine capacity with more than 10 rounds, overall length of less than 30 inches. Per Cal ifornia Penal Code § 30630 (a), sworn peace officer s are allowed to possess assault weapons on and off duty for law enforcement purposes. 219.3 SPECIFICATIONS A Personally Owned Rifle (POR) will be a n AR-15 style rifle, semi -automatic, with a n overall barrel length of at least 16 inches and overall length of at least 30 inches. Only manufacturers approved to be purchased for the Personally Owned Rifles (POR) are: a) Bravo Company ; b) Colt; c) Daniel Defense ; d) Heckler & Koch ; e) LWRC ; f) Sig Sauer ; g) Smith & Wesson ; h) Troy Industries ; i) Windham Weaponry ; j) Or any other manufacturer approved by the Department Rangemaster . CATEGORY DATE ADOPTED LAST REVIEW NEXT REVIEW 2 07/07/2016 08/01/201 9 08/01/20 20 TUSTIN POLICE DEPARTMENT GENERAL ORDERS _________________ _________________ 219 – Personally Owned Rifles (POR) 2 219.4 RIFLE STORAGE AND MAINTENANCE Primary responsibility for maintenance and storage of Personally Owned Rifle (POR) shall fall on the individual officer . The Personally Owned Rifles (POR) must be stored in a locked container, disabled by a firearm safety device, or maintained in a locked gun safe pursuant to California Penal Code § 25135 . 219.5 PROCESS TO REQUEST Sworn Peace Officers must request to purchase a Personally Owned Rifles (POR) . The officer must provide the make, model, serial number, and gun retailer location in writing vi a the chain of command . The sworn peace officer must agree and sign the Tustin Police Department Agreement for Use of Personal Rifle. At which point, a rifle buy letter will be drafted containing the above mentioned rifle information. The letter will be si gned by the Chief of Police. Per California Penal Code § 30630(b) states the required authorization is verifiable written certification from the head of the department, identifying the possessor of the assault weapon as a peace officer and authorizing tha t person to receive and posse ss that specific assault weapon . 219.6 INSPECTION The Personally Owned Rifle (POR) will be inspected by the Depa rtment Rangemaster upon initial acquisition. The Personally Owned Rifle (POR) can be subject to additional ins pections at the request of the Department Rangemaster or his designee . 219.7 SEPARATION FROM THE TUSTIN POLICE DEPARTMENT In the event a sworn peace officer separates from the Tustin Police Department, the officer shall transfer the firearm out of the State of California, surrender the rifle to the Tustin Police Department or modify the firearm to comply with California law and re -register the rifle to meet the requirements of California Penal Code § 30515.
