CATEGORY DATE ADOPTED LAST REVIEW 1 12/06/2021 12/06/2021 TUSTIN POLICE DEPARTMENT GENERAL ORDERS ________ _______ ____ _______ ____ ___ 210 – Police Action Death Inve stigations 1 POLICY 210 POLICE ACTION DEATH INVESTIGATIONS 210.1 PURPOSE AND SCOPE The purpose of this policy is to establish the criminal and administrative procedure for the investigation of police actions, other than use of force, that result in the death or ser ious bodily injury. 210.1.1 ACCREDITATION STANDARDS This section pertains to the following CALEA Standards: 11.3.4 This policy pertains to the following Standard Operating Procedures: N/A 210.2 CRIMINAL INVESTIGATIVE AUTHORITY Criminal investigation s are normally conducted by the law enforcement agency having primary jurisdiction and venue over the criminal aspects of the critical incident. The resulting documentation is normally submitted for review to the local District Attorney’s Office with jurisdiction of the crime. 210.3 ADMINISTRATIVE INVESTIGATIVE AUTHORITY The administrative investigation is normally conducted by the department to factually reconstruct the critical incident. The results of the investigation shall be recorded through an in ternal administrative investigation report process . 210.4 ROLE OF THE INDEPENDENT INVESTIGATING AGENCY The department will consult with the independent investigating agenc y for the coordination of the independent investigation to be conducted by such agency of the critical incident resulting in death o r serious bodily injury. The assigned incident commander or department personnel should work closely with the independent investigating agency to resolve any matters throughout the investigation. 210.5 PUBLIC INFORMATION PLAN FOR ALL INVOLVED PARTIES Any press release i nformation concerning a critical incident should be timely released after collective coordination and approval amongst the involved agencies. All California Public Records Act requests for release of information involving a critical incident should be referred to the Records Unit . All other requests for release of information involving a critical incident, including discovery of peace officer’s personnel records pursuant to Section 1045 of the Evidence Code, commonly referred to as Pitchess Motion(s), should be coordinated with the Professional Standards Division. CATEGORY DATE ADOPTED LAST REVIEW 1 12/06/2021 12/06/2021 TUSTIN POLICE DEPARTMENT GENERAL ORDERS ________ _______ ____ _______ ____ ___ 210 – Police Action Death Inve stigations 2 Pursuant to Section 6254(f) of the Government Code and Section 841.5 of the California Penal Code, information regarding a c riminal investigation can be withheld from the media if it can be proven the release of the information may: (1) Jeopardize the integrity and successful completion of the investigation, or ; (2) Endanger the safety of involved employees, suspects, witness es, and/or their family members. 210.6 TRAINING OF ALL AGENCY PERSONNEL The department’s Professional Standards Division will be responsible for the proper training of all agency personnel in conjunction with their respective roles within the departmen t. Such training will be updated in the employee ’s personnel training file.
