CATEGORY DATE ADOPTED LAST REVIEW 3 01/24/2011 05/01/20 21 TUSTIN POLICE DEPARTMENT GENERAL ORDERS ____________________________________________ 106 - General Orders and Standard Operating Procedures Manual s 1 POLICY 106 GENERAL ORDERS AND STANDARD OPERATING PROCEDURES MANUAL S 106.1 PURPOSE AND SCOPE The manual s of the Tustin Police Department are hereby established and shall be referred to as the “General Orders Policy Manual” or “General Orders” and the “Standard Operating Procedures Manual” or “SOP’s”. The General Orders are a statement of the current policies, procedures, rules and guidelines of this department. All employees are to conform to the provisions of this manual. All prior and existing manua ls, orders, and regulations which are in conflict with this manual are revoked, except to the extent that portions of existing manuals, orders and other regulations which have not been included herein shall remain in effect where they do not conflict with the provisions of this manual. In addition to the General Orders, Standard Operating Procedures (SOP’s) have been drafted to further assist department personnel in their daily duties and responsibilities. Except where otherwise stated, the provisions of these manual s shall be considered as guidelines. It is recognized, however, that police work is not always predictable and circumstances may arise which warrant departure from these guidelines. It is the intent of this manual to be viewed from an objecti ve standard, taking into consideration the sound discretion entrusted to members of this department under the circumstances reasonably available at the time of any incident. 106.1.1 ACCREDITATION STANDARDS This policy pertains to the following CALEA Stan dards: 1.2.7 , 4.1.2 , 4.3.4 , 12.2.1 , 12.2.2 , 33.2.4 , 33.7.1 , 41.2.2 , 74.3.2 , 82.3.5 106.2 RESPONSIBILITIES The ultimate responsibility for the contents of the manual s rests with the Chief of Police. Since it is not practical for the Chief of Police to prepa re and maintain the manual s, the following delegations have been made: 106.2.1 CHIEF OF POLICE The Chief of Police shall be considered the ultimate authority for the provisions of th e manual s and shall continue to issue updates, revisions, and new orders as they occur. 106.2.2 STAFF Staff shall consist of the Chief of Police , Deputy Chief of Police, Captain from each Bureau, and Civilian Commander. Staff shall review all recommendations regarding proposed changes to the manual s at regular staff meetings . CATEGORY DATE ADOPTED LAST REVIEW 3 01/24/2011 05/01/20 21 TUSTIN POLICE DEPARTMENT GENERAL ORDERS ____________________________________________ 106 - General Orders and Standard Operating Procedures Manual s 2 106.2.3 OTHER PERSONNEL All Department employees suggesting revision s or additions to the contents of the General Orders or Standard Operating Procedures Manual s should forward their suggestion, in writing, to their Bureau Commander via the chain of co mmand. The Bureau Commander will consider the recommendation and forward to staff as needed. 106.3 FORMATTING AND ORGANIZATION OF THE GENERAL ORDERS 106.3 .1 DEFINITIONS The following words and terms shall have these assigned meanings, unless it is ap parent from the content that they have a different meaning: Adult – Any person 18 years of age or older . CHP – The California Highway Patrol . City – The City of Tustin . C.F.R. – Code of Federal Regulations. Department/TPD – The Tustin Police Department . DMV – The California Department of Motor Vehicles . Employee/Personnel – Any person employed by the Department . Juvenile – Any person under the age of 18 years . Manual – The Tustin Police Department General Orders Manual . Member – All persons who are employe d by the Tustin Police Department , includ ing sworn officers , reserve officers, and civilian employees and volunteers . Officer/Civilian – Employees, including volunteers, regardless of rank, who are sworn employees of the Tustin Police Department serving in supporting roles, but lacking the authority to make full -custody arrests (no arrest powers) Officer/Sworn – Those employees, regardless of rank, who are sworn employees of the Tustin Police Department who possess full arrest powers in the State of Cali fornia under authority of CPC §830 and §832. On-Duty – An e mployee ’s status during the period when he/she is actually engaged in the performance of his or her assigned duties. Order – A written or verbal instruction issued by a superior. POST – The Califo rnia Commission on Peace Officer Standards and Training . Rank – The job classification held by an officer . Shall – Indicates a mandatory action Should (or may) – Indicates a generally required or expected action, absent a rational basis for failing to conf orm.
