CATEGORY DATE ADOPTED LAST REVIEW NEXT REVIEW 4 1/24/2011 05/01/201 9 05/01/20 21 TUSTIN POLICE DEPARTMENT GENERAL ORDERS _____ ____ _______ 104 - Oath of Office 1 POLICY 104 OATH OF OFFICE 104.1 PURPOSE AND SCOPE All members of this department are sworn to uphold the federal and state constitutions and to enforce federal, state and local laws. 104.1.1 ACCREDITATION STANDARDS This policy pertains to the foll owing CALEA Standards: 1.1.1 This policy pertains to the following Standard Operating Procedures: N/A 104.2 OATH OF OFFICE Upon employment, all sworn employees and all full-time civilian employees shall be required to affirm the oath of office express ing commitment and intent to respect constitutional rights in discharging the duties they are about to enter (Cal. Const. Art. 20, § 3 and Government Code § 3102). 104.3 WRITTEN OATH OF OFFICE This written Oath of Office is administered by the Chief of Police , or his/her designee, on the first practicable day after employment and before the new employee becomes engaged in police duties. The written Oath of Office is maintained in the employee’s personnel file. 104.4 PUBLIC ORAL OATH OF OFFICE Employe es may be scheduled to attend a Swearing -In ceremony or other public event to perform the ceremonial Oath of Office, publicly proclaiming their Oath of Office. This appearance should occur within the first 90 days of their employment. The Oath is adminis tered by the Chief of Police or other appropriate public official. 104.4.1 PUBLIC OATH OF OFFICE TEXT “I,____(Employee States Name)___, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States and the Constitutio n of the State of California against all enemies, foreign and domestic ; that I will bear true faith and allegiance to the Constitution of the United States and the Constitution of the State of California; that I take this obligation freely, without any men tal reservation or purpose of evasion; and that I will well and faithfully discharge the duties upon which I am about to enter.”
