B-61 SUBJECT: Extra Duty, Off Duty & Secondary Employment INDEX AS: Extra Duty, Off Duty & Secondary Employment RESCINDS: A-2011 -2 REVISES: DATE REVISED : 09/26/2022 DISTRIBUTION SWORN MEMBERS I. PURPOSE: The purpose of this directive is to estab lish guidelines to govern extra duty and secondary employment of department members. II. SCOPE: This directive applies to all members. III. DISCUSSION: The department and the public expect members to be capable of performing their duties in the prescribed manner and not to be fatigued due to excessive outside employment or overtime work. Further, the department has a responsibility to uphold its integrit y by not permitting members to work in secondary employment that will adversely affect the reputation of the department. The Professional Standards Supervisor or his/her designee is the designated point of coordination to oversee adherence to the procedur es relating to off duty employment, private extra duty employment, and D epartment scheduled extra duty employment. It is the intent of the Temple Terrace Police Department to allow members to enga ge in off duty employment and to allow sworn officers to en gage in extra duty employment, subject to reasonable restrictions and guidelines. Self-employment or work performed by members for an employer other than the City of Temple Terrace is a privilege, not a right. Members are paid for full time service to th e agency, and the Chief of Police retains the right to approve work after normal duty hours by sworn, certified, or civilian members, as a condition of employment. This includes limiting the number of hours that can be worked on off duty time. IV. DEFINITION S: A. Department Scheduled Extra Duty Employment - any extra -duty employment scheduled through the Department . B. Employment - The provision of a service, wheth er or not in exchange for a fee or other service. Employment does not include volunteer charity work . C. Extra Duty Employment - Secondary employment that is conditioned upon the actual or potential use of law enforcement powers by a police officer . D. Off Duty Employment - Secondary employment which is not conditioned upon the actual or potential use of law e nforcement powers by a police officer . __________________________________________ __________________________ _______________________________ General Order B-61 2 of 10 Extra Duty & Secondary Employment E. Secondary Employment - Any employment other than primary employment by the Temple Terrace Police Department . This does not include off duty or extra duty employment. F. Last Minute Extra Duty - Assignments that are received on short notice and are impractical to assign using the computer based system. At the discretion of the Professional Standards Office, t hese jobs will be filled using a method most likely to have positive results . G. Exigent Circumstances – A circumstance that arises either after normal business hours or on weekends within 24 hours of an extra duty assignment, and is due to the officer being too sick or injured to work. The offic er must be able to provide proof of the emergency (i.e. doctor’s note). V. PROCEDURE: A. CONDUCT: Members engaged in secondary employment are held accountable for their actions and must comply with all departmental procedures, rules, and regulations, whether in uniform or not. These requirements include existing orders, jur isdictional limitations, availability for call back to regular duty, limitations on the number of hours that may be worked in outside employment, and use of departmental property . B. APPROVAL FOR SECONDARY EMPLOYMENT: 1. Any member seeking to engage in off duty or self employment must submit a written request for secondary employment to their immediate supervisor, who forwards it up through the Chain of Command. Members must receive written authorization from the Chief of Police before engaging in such emplo yment. These requests are to include descriptions of the date, time, place of employment, and significant aspects of the job and must be renewed during each January . Authorization for secon dary employment may be denied for reasons outlined in this direct ive. 2. Members are responsible for immediately reporting to the Department any changes in their secondary employment. C. LIMITATIONS ON SECONDARY EMPLOYMENT: 1. Limitations on secondary employment are as follows: a. To be eligible for secondary employment, a membe r must be in good standing with the department. Continued departmental approval of a member's secondary employment is contingent upon such good standing . b. Officers are eligible to engage in department scheduled extra duty or off duty employment as outline d in the current FOP bargaining agreement . c. Members previously approved for secondary employment that are on medical or other leave due to sickne ss, temporary disability, or on duty injury, are not eligible to engage in secondary employment without approva l from the Chief of Police . d. Work hours for all secondary employment must be scheduled in a manner that does not conflict or interfere with the member's performance of duty. e. Any member engage d in any secondary employment is subject to call -out in case of emergenc y, and is expected to leave off duty or extra duty employment in such situations . f.
