B-57 SUBJECT: SEXUAL OFFENDER MONITORING PROGRAM INDEX AS: SAME AS ABOVE RESCINDS: TB 98 -1 REVISES: DATE REVISED: 11/23 /2017 DISTRIBUTION ALL MEMBERS I. PURPOSE: The purpose of this standard operating procedure is to establish guidelines for the appropriate community notification and monitoring of Sexual Predators and Sexual Offenders who are residing in the City of Temple Terrace . II. SCOPE: All Members III. DISCUSSION: It is the policy of the Temple Terrace Police Department to notify the community of the presence of sexual predators and sexual offenders who reside within or near the cit y limits of Temple Terrace, in a manner that is deemed appropriate by the Chief of Police. The intent of the Temple Terrace Police Department is to locate all sexual offender/predators within the community, verif y there are no existing warrants, and obtain new warrants through the states attorney’s office when non -compliant felons are located. This will be a continuation of efforts by the Temple Terrace Police Department to track these offenders and send yet anoth er strong message that Temple Terrace will not tolerate those who do not follow the laws pertaining to their status as a sexual predator/offender. IV. DEFINITIONS: A. Community - For the purpose of this policy, any reference to community shall refer to an area within or near the city limits of Temple Terrace and/or the neighborhood in which the sexual predator/offender lives or otherwise establishes temporary or permanent residence. B. Sexual Offender - Any person convicted of committing or attempting, conspiring, or soliciti ng to commit certain offenses designated by Florida Statutes (F.S.), or similar offenses in another jurisdiction, or any similar offense committed in this state which has been re -designated from a former statute number, to one of those listed in F.S. 943.0 435 subparagraphs 1, 2 and 3 . C. Sexual Predator - Any person who has been convicted or is found to have committed regardless of adjudication, or who pleads nolo contendere or guilty to any of the _____________________________________________________________________________ General Order B -57 2 of 4 Sexual Offender Monitoring Program qualifying offenses listed under F.S. 775.21(4) which occurred afte r October 1, 1993, and for whom the court has made a written finding of sexual predator status . 1. Additionally, as of July 1, 2004, regardless of whether an individual meets or does not meet the criteria listed above, anyone civilly commi tted under the Florida Jimmy Ryce Sexually Violent Predator Act must register as a sexual predator. V. PROCEDURES : A. RESPONSIBILITIES : 1. FDLE a) FDLE must notify the Sheriff, the State Attorney and the Chief of Police of the community in which a predator/offender resides upon their registration as a sexual pr edator/offender. This notification is available via FDLE's website. b) FDLE maintains on -line current information regarding eac h registered sexual predator/offender and operates a sexual predator/offender hotline access (1 - 888-357-7332) that can be utilized by law enforcement agencies to obtain information for purposes of monitoring, tracking and prosecution. c) FDLE will also provid e the affected law enforcement agencies with a camera - ready flyer that will include a photograph of the sexual predator/offender, a description of the predator/offender , and a general statement of the crime(s) committed by the offender/predator . d) Quarterly, FDLE notifies law enforcement agencies of sexual offender s or predators who have failed to respond to address verification mail outs. The Investigative Services Division (ISD) Commande r, or designee, shall ensure that offender address verifications from this list are conducted at all locations within the City limits of Temple Terrace . Update s shall be forwarded to FDLE as appropriate. 2. Temple Terrace Police Department a) The Chief of Police shal l authorize the release of sexual predator/offender information to anyone who requests it and may unilaterally notify the community in any manner he/she deems appropriate, unless the information is confidential or exempted from disclosure under Chapter 119 . b) By statute, notification of the community is mandatory for sexual predators an d optional for sexual offenders . The Temple Terrace Police Department has elected to take a strong approach to community notification and shall make every effort to keep the community apprised of all offender or predator residence s and re -locations as well as any other information allowed by law. Offenders shall be monitored and documented a minimum of once each month. 3. Criminal Investigations Unit a) The Criminal Investiga tions Unit (CIU) Supervisor or designee will subscribe to the FDLE “Offender Alert” program for the purpose of obtaining email notifications with additions or new information to the current list of sexual offenders and sexual predators residing within or n ear the city limits of Temple Terrace . Alerts with additions to the list or changes of address shall be forwarded to the Command Staf f. b) The CIU Supervisor or designee shall be resp onsible for the creation of an offender profile
