B-28 SUBJECT: DUI INVESTIGATIONS INDEX AS: SAME AS ABOVE RESCINDS: REVISES: DATE REVISED: 09/08/2025 DISTRIBUTION SWORN MEMBERS I. PURPOSE: The purpose of this general order is to establish guidelines for the enforcement of the alcohol and drug -impaired driving statutes and the investigation of alcohol and drug - impaired driving -related traffic crashes. II. SCOPE: Sworn Members III. DISCUSSION: The enforcement of alcohol and drug-impaired driving statutes and the investigation of alcohol and drug -impaired driving -related traffic crashes has become increasingly more sophisticated. The heightened concern of the public and the need for more precise enforcement and investigative techniques re quires a set of concise operating guidelines. IV. DEFINITIONS: A. Standardized Field Sobriety Exercises - A group of ex ercises used by law enforcement officers to detect driver impairment. The results of these exercises, usually administe red along the roadside, assist law enforcement in determining if a driver is impaired . B. Horizontal Gaze Nystagmus (HGN) - This exercise require s the officer to move an object such as a pen or pencil horizontally in front of the subject’s eyes. The officer make s observations by looking for lack of smooth pursuit, maxim um deviation and onset prior to 45 degrees. The subject should follow the stimulus with th eir eyes only, not moving their head until the exercise is over. C. Walk -and-Turn-(WAT ) - This exercise requi res the suspect to put the left foot on the line and the right foot directly in front of it, touching heel -to-toe. The suspect’s hands are kept straight at the sides. At the officer’s command, the suspect takes n ine (9) steps forward, heel-to-toe, count ing each step out loud. After the first nine (9) steps, turn around by leaving the front foot on the line and taking small steps with the back foot while pivoting the front foot until back on the line facing the opposite direction. Take nine (9) steps, he el-to-toe, in the new direction returning to the point of the beginning. _____________________________________________________________________________ General Order B -28 2 of 9 DUI-DRE D. One-Leg-Stand -(OLS) - This exercise requires the suspect to stand with his/her feet together and his/her arms at their side. The suspect raises one foot a pproximately six (6) inches off the ground, foot pointed out, both legs straight, looking at the elevated foot. The suspect counts out loud in the following manner, “one thousand one, one thousand two”, and so on until told to stop. Subject should be timed for 30 seconds. E. Numeric Recitation - This exercise requires the suspect to stand with feet together, arms and hands hanging straight down to the sides, head tilted s traight back, and eyes closed. The suspect is directed to recite the numbers designated by the officer in a decreasing or increasing manner. F. Finger To Nose - This exercise requires the suspect to stand with feet together, both arms held straight down to the sides with index fingers extended down. Eyes are closed and the head tilted back. With the hand designa ted by the officer (standard order left, right, left, right, right, left) , the suspect brings hand upward touching t he tip of the finger to the tip of the nose, and then remove, returning the arm to the original position. G. Alphabet Recitation - This exercis e requires the suspect to stand with feet together, arms and hands hanging straight down to the sides, head tilted straight back, and eyes closed. The suspect recites the alphabet from A -Z in a non -rhythmic manner. H. Driver - A person who operates or is in physical control of a vehicle. I. Drug - Any substance which, when taken into the human body, can impair a person’s ability to operate a vehicle safely. J. Drug Evaluation - A process of systematically examining a person suspected of being under the influence of a drug, for the purpose of ascertaining what category of drug may be causing the person’s impairment. K. Drug Recognition Expert Procedure - A systematic, standardized method of examining the suspected impaired driver. L. Drug Recognition Expert (DR E) - An individual who has successfully completed all phases of training requirements for certification established by the International Asso ciation of Chief’s of Police (I ACP) and the National Highway Traff ic Safety Administration (NHTSA ). M. Drug Recognition Expert Coordinator (DRE Coordinator ) - A person designated within the Department who is responsible for maintaining program records, ensuring maintenance of program standards, facilitating training and certification sessions. V. PROCEDURE: A. Training 1. All sworn person nel shall be trained on DUI detection and standardized field sobriety exercises before initiating a DUI investigation as the lead investigating officer. B. Detection - The detection of an impaired driver is ideally conducted during three (3) phases, Vehicle in Motion, Personal Contact, and Pre -Arrest Screening (also known as Field Sobriety Evaluations).
