A. POLICY
It is the policy of the Sunny Isles Beach Police Department to utilize facial recognition technology to examine and
compare distinguishing character istics of a human face through the use of biometric algorithms contained within a
software application. This technology can be a valuable investi gative tool in developing leads for a criminal or
Internal Affairs investigation, detecting and preventing crimin al activity, reducing an imminent threat to health or
safety, and helping in the identification of deceased persons o r persons unable to identify themselves such as
individuals with special needs or young children.
B. SCOPE AND APPLICABILITY
This policy shall apply to all sworn and civilian members. The Chief of Police or designee will authorize access to
facial recognition platforms.
C. DEFINITIONS
Authorized User : Chief of Police or designee.
Commercial Facial Recognition Platform : Facial recognition software/a pplication that is owned and
operated by a private sector entity. The use of facial recognition software shall be governed as di rected in this
policy and/or other department policies.
Confirmation Bias : The tendency to interpret new evidence as confirmation of one 's existing beliefs or theories.
Avigilon Facial Recognition or CLEARVIEW: An investigative tool and any law enforcement action taken
based on a submission to CLEARVIEW and shall be based on person nel’s own identity determination and not
solely the results of CLEARVIEW search

Facial recognition technology : A computer software/application capable of comparing specific physical features
of a person depicted in a probe photograph against a database o f images of people identified through other open
source and publicly available means.
Facial recognition search result : An image returned by facial recognition technology that repre sents a potential
investigative lead based on an a lgorithmic similarity to the su bmitted image.
Identification: The action or process of identif ying a person. A positive faci al recognition search result alone
does not constitute probable cause for arrest. The search resul t shall be evaluated by the arresting officer or lead
investigator and requires investigative follow-up to corroborat e the lead by taking such actions including but not
limited to: reviewing all releva nt reports, conducting intervie ws, presenting photographic line-ups, and examining
all other evidence (i.e. latent prints and DNA). When deciding to arrest based on all factors, the arresting officer
or lead investigator shall take into consideration the quality of the probe photograph a nd the facial recognition
search results.
Probe Photograph : A still shot/image which is uploaded to the facial recognitio n software/application.
Service Agreement : A contract which sets out the terms and conditions for servic e between the City and the
Service Provider.
D. RESPONSIBILITIES
1. It is the purpose of this policy to provide members with guidel ines and principles for the collection, access,
use, and dissemination of images and related information applic able to the use of facial recognition
technology.
2. This policy will ensure that a ll facial recognition technology uses are consistent with authorized purposes
while not violating the privacy, civil rights, and civil libert ies of individuals. All members who make use of
facial recognition technology shall familiarize themselves with the limitations of such technology, including
algorithmic biases toward affected demographic groups.
E. PROCEDURES
1. Facial recognition technology shall only be utilized by departm ent members as determined by the Chief of
Police or designee.
2. Facial recognition technology access credentials are specific t o individual authorized user accounts, and these
credentials shall only be used by department members assigned t o an account. Authorized users shall keep
their credentials private and not share with anyone to include authorized users of facial recognition
technology.
