A. PURPOSE:
The purpose of this directive is to establish guidelines for the handling, care, and transport of individuals who fit
the criteria of Florida Chapter 397, known as the “Hal S. Marchman Alcohol and Other Drug Services Act of 1993.”
All members are reminded that intoxication and mental illness are not crimes.
B. SCOPE:
This directive is applicable to all sworn and communications members of the Department.

C. POLICY:
It is the policy of the City of Sunny Isles Beach Police Department to provide immediate response to and
management of incidents and calls involving substance abuse impairment utilizing a humane approach that
preserves the dignity, confidentiality and the utmost concern for their safety and wellbeing, in accordance with
established laws and procedures.
D. DEFINITIONS:
Crisis Intervention Team (CIT): A voluntary team of members who have each received forty (40) hours of
specialized training in mental health issues and communication including de-escalation techniques. CIT members
work in partnership with the Miami-Dade County mental health professional community. This partnership is
designed to meet the needs of the mentally ill in crisis, ensure the diversion of mentally ill to treatment centers
and/or programs, minimize the amount of time members spend on calls, and maintain community safety.
Crisis Intervention Team Coordinator : A member appointed by the Chief of Police or designee to handle the
administrative, training, and operational aspects of the Crisis Intervention Team program.
Ex Parte Order : A signed order of an appropriate Court judge requiring that the person named in the order be
taken into custody and delivered to a designated receiving facility for an involuntary examination.
Mental Health Crisis : A situation in which a person’s behavioral, emotional, or psychiatric situation puts them
at risk of hurting themselves or others and/or when they are not able to resolve the situation with the skills and
resources available.
Mental Health Consumer (The Consumer) : Any person who is held or accepted for mental health treatment.
Mental Illness : An impairment of the mental or emotional processes that exercises conscious control of one’s
actions or of the ability to perceive or understand reality, which impairment substantially interferes with the person’s
ability to meet the ordinary demands of living. The term does not include retardation or developmental disability as
defined in Chapter 393 – Developmental disabilities, or intoxication, or conditions manifested only by antisocial
behavior or substance abuse impairment.
Receiving Facility : Any public or private facility designated by the State of Florida Department of Children &
Families Services to receive and hold involuntary or voluntary patients under emergency conditions or for
psychiatric evaluation and to provide short term treatment. The term does not include a county jail.
E. CRISIS INTERVENTION TEAM (CIT) PROGRAM:
1. The City of Sunny Isles Beach Police Department recognizes the growing need to address community mental
health issues in the public safety arena. The CIT was created to provide immediate response to and
management of situations where the mentally ill are in a state of crisis; prevent, reduce and/or eliminate injury
to both the consumer and the responding member; find appropriate care for consumers; reduce consumer
recidivism and to ensure the individual receives the proper mental health services and the proper diversionary
steps are taken for the safety and welfare of the mentally ill person or others.
2. The CIT consists of members of the Sunny Isles Beach Police Department that have completed a forty (40)
hour training session conducted by the Eleventh Judicial Circuit Criminal Mental Health Project. Active CIT
members may wear the CIT pin on their police uniform.
