The purpose of this directive is to describe the circumstances under which juveniles may become the subjects of a contact with police and to provide guidelines for members to follow with regard to juveniles. Florida State Statutes Chapters 39, 984 and 985, govern the handling and treatment of juveniles and shall be referred to for additional guidance in juvenile matters. 2. During juvenile related encounters, members shall keep in mind that the intention of juvenile law is to divert as many juveniles as practical from the formal aspects of the Criminal Justice System into counseling, warning, mentoring, or other alternative situations. JUVENILE PRODECURES Policy 507 GO 5K01 Juvenile Procedures Page 2 of 15 Rev. 01/16/22 B. SCOPE This directive is applicable to all sworn members of the Department. C. POLICY 1. It is the policy of the City of Sunny Isles Beach Police Department to promote public safety and reduce juvenile delinquency by maintaining the integrity of the substantive law prohibiting certain behaviors by juveniles while at the same time taking into consideration the unique characteristics and needs of children. In all cases, the Constitutional rights of juveniles taken into custody will be protected regardless of whether or not the juvenile will be processed or released in the field. 2. The words “juvenile,” “child,” and “youth” as used in this directive shall be synonymous with each other. D. DEFINITIONS Child in Need of Services: (FSS 984.13) - Means a juvenile for whom there is no pending investigation into an allegation or suspicion of abuse, neglect, or abandonment; no pending referral alleging the child is delinquent, or no current supervision by the Department of Juvenile Justice or the Department of Children and Families for an adjudication of dependency or delinquency. The child must also have been found by the court: 1. To have persistently run away from the parents or legal custodians despite reasonable efforts of the child, the parents or legal custodians, and appropriate agencies to remedy the conditions contributing to the behavior. 2. To be habitually truant from school, although subject to compulsory school attendance. 3. To persistently disobey the reasonable and lawful demands of a parent or other legal custodian and to be beyond their control. Delinquent Act: An act which, if committed by an adult, would be a violation of law. This includes felonies, misdemeanors, criminal traffic violations, violations of City ordinances, and, when applicable, violations of federal law. Delinquent Child: A juvenile who is found by the court to have committed a felony, misdemeanor, contempt of court, or a violation of a local ordinance (punishable by incarceration) and whose case has not been prosecuted as an adult. Dependent Juvenile/Child: A child who, pursuant to FSS 39.401 , is found by the court: 1. To have been abandoned, abused, or neglected by a parent or legal custodian/s. 2. To have been surrendered to the Florida Department of Children and Families or licensed child-placing agency for the purpose of adoption. 3. To have been voluntarily placed with a licensed child-caring agency, a licensed child-placing agency, an adult relative, the department, or the former Department of Health and Rehabilitative Services, after which placement, under the requirements of this chapter, a case plan has expired and the parent or parents or legal custodians have failed to substantially comply with the requirements of the plan.
