PURPOSE The purpose of this policy is to establish procedures to follow when an escape of a prisoner occurs during transport. B. POLICY It is the policy of the Sunny Isles Beach Police Department to comply with applicable federal, state and local laws when a prisoner escapes during transport. In addition, it is the policy of the Department to do everything possible in these situations to keep the members of the public safe. C. TRANSPORTING OFFICER’S RESPONSIBILITIES 1. Upon the escape of a prisoner during transport, the transporting officer shall: a. Immediately notify the dispatcher of the escape; b. Give a complete BOLO including; c. A full physical description (height, weight, age, gender, race, hair and eye color, clothing, hair length and any distinguishing characteristics); d. Charge(s); e. Direction of travel; f. Time delay; and g. Whether the prisoner is handcuffed or armed and if so with what kind of weapon. If the escape occurs outside of Sunny Isles Beach or the escapee flees to another jurisdiction, the officer may request the closest responding unit from that jurisdiction set up the perimeter. D. SUPERVISOR’S RESPONSIBILITIES 1. The supervisor shall: a. Respond to the scene to ensure the scene is protected as if it is a crime scene and take charge of the search for the escapee; b. Determine the number and type of units required for the search; c. Have the necessary specialty units (i.e. K-9, SWAT, etc.) called out; d. Notify command personnel as deemed appropriate; e. Determine what threat, if any, the escapee poses to the community; f. Determine if evacuation or notification should be given to the public; and g. Make the decision as to when to discontinue the search if the escapee is not recaptured. E. OTHER JURISDICTIONS 1. Should the escape occur outside the Department’s jurisdiction or should the escapee flee outside the Department’s jurisdiction, the above procedures shall be followed and all search efforts shall be coordinated with such jurisdiction. In addition, the supervisor shall request that the dispatcher immediately notify the affected jurisdiction. 2. Command of the search area shall be decided by the on scene Department supervisor and the on scene ranking officer of the affected jurisdiction. F. REPORTING 1. The officer having charge of the prisoner at the time of the escape shall complete an incident report detailing the occurrence. 2. Any officer directly involved in the recapture shall complete a supplement to the incident report. 3. Upon recapture of the prisoner, the officer in charge of the prisoner at the time of the escape shall complete a separate offense report and/or Arrest Affidavit listing appropriate charge(s). The officer shall also notify MDCR personnel that the prisoner had escaped. 4. If the escapee is not recaptured, any officer having information pertaining to the escape, such as, where the escapee was last seen or any information learned from witnesses or other sources shall complete a supplement detailing such information. 5. All reports shall be forwarded to the Detective Bureau for follow-up.
