A. PURPOSE
The purpose of this directive is to define and provide details of the scope and limits of law enforcement authority
in the context of arrests and investigatory stops.

B. SCOPE
This directive is applicable to a ll sworn members of the Depart ment.
C. POLICY
City of Sunny Isles Beach Police Department sworn members will discharge their duties under the direction of, and
according to the directives of the City of Sunny Isles Beach Po lice Department, the Charter and Ordinances of the
City of Sunny Isles Beach, Flo rida, and the Constitutions of th e United States of America and the State of Florida.
D. DEFINITIONS
Arrest: To deprive a person of his/her l iberty (seize), by legal author ity, to answer a criminal charge.
Arrest Affidavit: A sworn statement by the arresting member which describes the accused, the charges and
probable cause for the arrest.
Arrest Warrant: A written order signed by a judge commanding the arrest of th e person named therein.
Custodial Search: A complete search of a subject when the subject is taken into c ustody in an unsecured
environment.
Discretion: The authority to make decisions within legal boundaries using reasonable personal judgment. Use of
discretion is guided and framed by law, policies, rules, proced ures, training, and supervision.
Fresh Pursuit Exception: An exception to the general rule that police officers have no official power to arrest an
offender outside their jurisdic tion. The "fresh pursuit" except ion allows officers, who attempt to detain or arrest an
individual within their jurisdiction, to continue to pursue the suspect even though the s uspect crosses jurisdictional
lines. Hit (also referred to as Computer Hit): An affirmative or positive response to a database inquiry as to whether
a person is wanted by a law enfor cement agency on an outstandin g arrest warrant, capias, or other pickup order.
Pat-Down Frisk: A limited protective search for concealed weapon(s) and/or dang erous instrument(s). Usually, it
occurs during a “stop” and consists of a pat-down or “frisk” co nducted in a predetermined pattern of the outer
garments of an individual to det ect the presence of weapons or other dangerous objects. A member may conduct a
pat-down frisk of a person on the basis of “reasonable suspicio n” that the person is carrying a concealed weapon or
dangerous instrument. A pat-dow n frisk is done for one purpose only: officer safety.
