A. PURPOSE
The purpose of this policy is to identify prohibited acts of ha rassment in the workplace; to establish reporting
procedures if an act of prohibited harassment occurs; and to ad dress reported incidents in a fair, impartial and speedy
manner.
B. POLICY
1. It is the policy of the City to ensure that all employees are a ble to work in an environment which is free from
all forms of harassment and discrimination on the basis of race , color, age, sex, pregnancy, national origin,
ancestry, citizenship status, religion, marital status, familia l status, sexual orientation, genetic information,
disability, and any other characteristic protected by federal, state or local law.
2. Harassment and discrimination of a ny form is prohibited and wil l result in disciplinary action up to and
including termination. The City also prohibits retaliation agai nst any individual who has opposed unlawful
discrimination or harassment, or participated in any manner in an investigation, proceeding, or hearing
regarding unlawful discrimination or harassment. Harassment of any kind will not be tolerated.
3. The City Manager or designee is charged with the overall respon sibility for the administration of this policy.
The City’s basic goal is the e qual and fair treatment of all em ployees.
4. The City desires to establish and maintain a respectful and pro fessional work environment. Harassment based
on an employee's legally protected characteristic is destructiv e in nature and does not further the business
mission of the City. The City is committed to maintaining a wor k environment free of harassment by any
employee, vendor, customer, supp lier, volunteer or anyone else.

5. The City will not tolerate any sexually related or any other co nduct by any employee, vendor, customer,
volunteer or supplier which harasses, disrupts, embarrasses, in timidates, offends, or threatens another person
on the basis of a legally protected characteristic. All personn el are responsible for maintaining a work place that
is free of any form of harassment and intimidation.
6. Any employee, vendor, customer, volunteer, or supplier who afte r an investigation is determined to have
violated this policy shall be subject to the disciplinary measu res available to the City up to and including
termination of employment and/or cessation of contact with the City. Appropriate follow-up steps will be taken.
7. Harassment by an employee directed to a vendor, customer, volun teer, supplier or other non-employee whom
the employee knows or is in contact with because of the employe e's employment with the City is prohibited.
This policy also prohibits conduc t which witnesses reasonably b elieve constitutes harass ment of another based
on the employee's legally protected characteristic.
C. DEFINTIONS
Department – Sunny Isles Beach Police Department
Harassment – Any physical or verbal actions that a reasonable person would deem as abusive and have the purpose
or effect of creating a hostile, offensive, humiliating or inti midating working environment.
Member – Any employee of the Sunny Isles Beach Police Department, whet her sworn or non-sworn, no matter the
rank.
Sexual Harassment- Unwelcome sexual advances, requests for sexual favors, and othe r physical, verbal or visual
conduct of a sexual nature constitu te sexual harassment when, t he conduct creates an intimidating, hostile or
offensive work environment; has the purpose or effect of interf ering with an employee’s work performance;
submission to that conduct is an explicit or implicit term or c ondition of employment or continued employment; or
submission to or rejection of the conduct is used as a basis fo r employment decisions affecting an employee, such
as promotion, demotion or evaluation. Sexual harassment also in cludes any other sexually related behavior by an
employee which is unwelcome by another person. Such conduct may include, but is not limited to, repeated sexual
flirtations, advances, staring o r propositions; verbal abuse of a sexual nature including sexually related comments
or jokes, kidding or teasing, requests for sexual favors, sexua l innuendos, graphic or degrading comments about a
person’s appearance or sexually degrading words to describe tha t person; sexually suggestive comments or
movements directed toward that person, and suggestive or obscen e gestures; any uninvited physical contact which
is sexual or offensive in natur e,
