PURPOSE The purpose of this policy is to establish the Sunny Isles Beac h Police Department’s active role in promoting and protecting all citizens against intimidation, harassment, and c riminal acts that are based on race, religion, ethnicity, color, ancestry, sexual orientation, national origin, homeless status, mental or physical disability and/or advanced age. B. SCOPE This policy applies to all members of the Sunny Isles Beach Pol ice Department taking action of a reported or observed incident of a hate crime, as defined by this policy an d applicable federal, state, and local laws. C. POLICY It is the policy of the City of Sunny Isles Beach Police Depart ment to safeguard the state and federal rights of all individuals irrespective of their race, religion, ethnic backgr ound, sexual orientation, gender, age, or disability, and to define appropriate steps for assisting victims and apprehend ing suspects. Any acts or threats of violence, property damage, harassment, intimidati on, or other cri mes designed to i nfringe upon these rights ar e viewed very seriously by this agency and will be given h igh priority. The City of Sun ny Isles Beach Police Department will use every necessary resource rapidly and decisively to identify the perpe trators, arrest them, and take vigorous enforcement action. DEFINITION Hate Crime (as defined by FSS 775.085) – Any criminal act or attempted criminal act by anyone against a person or a person’s property, which constitutes an expression of hatr ed toward the victim because of their race, religion, ethnicity, color, ancestry, sexual orientation, national origin , homeless status, mental or physical disability and/or advanced age. E. PROCEDURES 1. When a member at the scene of an incident believes that it may have been motivated by bi as against the victim because of race, religion, ethnicity, sexual orientation, gende r, age, or disability, the officer shall take any preliminary actions necessary such as: a. Requesting the shift supervis or to respond to the scene. b. Stabilizing the victim(s) and requesting medical attention when necessary. c. Ensuring the safety of victims and witnesses. d. Express empathy to the victim, showing a sincere interest in hi s/her well-being. e. Allow the victim a period in whi ch to vent his/her immediate co ncerns and express said feelings. f. Assist the victim in identifyi ng and contacting individuals or agencies that may provide support and assistance. These may include: Family members. Close friends. Family clergy. Community service agencies that provide victim assistance or sh elter, food, clothing, childcare, or other related services. g. During the on scene investigation of Hate Crimes, members will: 2. Preserve the crime scene, collect and photograph physical evide nce such as: a. Hate literature. b. Spray paint cans c. Threatening letters. d. Symbolic objects used by hate groups. (
