A. PURPOSE
The purpose of this directive is to establish procedures for De partment members to quickly and properly respond
to any threat to public safety , while still safeguarding due pr ocess rights of a respondent.
B. SCOPE
This directive is applicable t o sworn department members.
C. POLICY
1. It is the policy of the City of Sunny Isles Beach Police Depart ment to provide detailed guidance and procedures
to sworn members when requesting a Risk Protection Order. In Ma rch, 2018, the Florida Legislature passed the
Marjory Stoneman Douglas High Sc hool Public Safety Act. One of the provisions of the Act was creating a
new Florida Statute, 790.401, which allows a law enforcement ag ency to petition the court for an Ex Parte Risk
Protection Order (or Temporary RPO) when the respondent poses a significant danger of causing personal
injury to himself or herself or others by having a firearm or a ny ammunition in his or her custody or control or
by purchasing, possessing, or receiving a firearm.
2. A Temporary RPO requires the respondent to temporarily surrende r to law enforcement all firearms and
ammunition owned, pending a sub sequent hearing that may conside r a request for a longer period of protection
(or RPO) if necessary.

3. The statute does not affect the ability of a law enforcement of ficer to remove a firearm or ammunition or license
to carry a concealed weapon or concealed firearm from any perso n or to conduct any search and seizure for
firearms or ammunition pursuant to other lawful authority.
D. DEFINITIONS
Petitioner: A law enforcement officer or a la w enforcement agency that pet itions a court for a risk protection order
in Section 790.401 , Florida Statutes.
Respondent: An individual who is identified in a petition filed in Section 790.401 , Florida Statutes.
Risk Protection Order (RPO ): An order entered by a Judge that prohibits the possession or purchase of firearms
or ammunition by Respondent for the length of time the order is in effect.
Temporary Ex-Parte Risk Protection Order : The signed order from a Circu it Judge requiring the responden t to
surrender to the named Law Enforcement entity any and all firea rms and other weapons a nd ammunition respondent
has in his/her possession, and an y license to carry a concealed weapon or firearm issued to respondent under Section
790.06, Florida Statutes. Unless otherwise stated
