PURPOSE The purpose of this directive is to establish guidelines for di rection and procedures concerning involvement by City of Sunny Isles Beach Police Depa rtment members handling civil p rocess. B. SCOPE This directive is applicable to all sworn members of the Depart ment. C. POLICY It is the policy of the City of Sunny Isles Beach Police Depart ment that members shall become involved in civil matters only to the extent neces sary to preserve the peace. Sun ny Isles Beach Police Department members will not become involved in the service of civil court or ders, except as mandated by law, judicial Administrative Orders or as allowed for by this directive. When questions arise concerni ng the legal process regarding civil matters, members shall consult with their supervi sor and/or the Florida Law Enfo rcement Handbook legal guidelines. TvvÉâÇ àtu|Ä|àç? tÇw exáÑxvàAÊ D. PROCEDURES 1. Pursuant to Florida law, municipal law enforcement officers are not authorized to serve civil process. However, per Administrative Order issued by the Chief Judge of the 11th Judicial Circuit, municipal police officers are authorized to serve domestic or repeat violence injunctions on the scene of a domestic call pursuant to F.S.S 741.30 . 2. Members are also allowed to execute Baker Act and Marchman Act ex-parte orders pursuant to F.S.S. 394.463 and F.S.S. 397.697 . Whenever members respond to a lo cation involving the enforcement of a ci vil court order stated within this directive, they shall: a. Request a supervisor. Enforce exactly what the order states unless there is independe nt criminal conduct, in which case, appropriate action shall be taken. Determine that the court order is a certified copy which includ es the Clerk of the Court stamp. Determine that the language in th e order provides for municipal officers to enforce the order. b. Confer with the on-duty Assistan t State Attorney, if necessary. c. Provide the Petitioner (victim) with the case number. 3. In some cases, the language in the civil court order directs th e police to make arrests for violations of the terms of the order or empowers the appropriate law enforcement agency to enforce the order.
