A. PURPOSE
The purpose of this policy is to establish procedures for membe rs of the Sunny Isles Beach Police Department
responding to domestic violence incidents in compliance with Fl orida Statutes §741.29 and §943.1701.. In addition,
this policy establishes guidelines for serving injunctions for protection against domestic, da ting, and repeat violence.
B. POLICY
It is the policy of the Sunny Isles Beach Police Department to safely and swiftly respond to incidents of domestic,
dating, and repeat violence; to develop strong cases against su spects of such violence while recognizing the safety
of all victims involved; and to comply with all local, state, a nd federal laws relating to such calls for service.
It is also the policy of the Sunny Isles Beach Police Departmen t to serve injunctions for protection against domestic,
dating, and repeat violence in accordance with applicable local , state, and federal laws.
C. SCOPE AND APPLICABILITY
This policy applies to all Department members who are engaged i n field related law enforcement response duties
and/or who may come into contact with potentially hazardous mat erials.

D. DEFINITIONS
Dating Violence – violence between individuals who have or have had a continuin g and significant
relationship of a romantic or in timate nature. The existence of such a relationship shall be determined based
on the consideration of the following factors: (1) a dating rel ationship must have existed within the past six
months; (2) the nature of the relationship must have been chara cterized by the expectation of affection or
sexual involvement between the p arties; and (3) the frequency a nd type of interaction between the persons
involved in the relationship must have included that the person s have been involved over time and on a
continuous basis during the course of the relationship. The ter m does not include violence 2in a casual
acquaintanceship or violence be tween individuals who only have engaged in ordinary fraternization in a
business or social context.
Department – the Sunny Isles Beach Police Department
Domestic Disturbance – Interruption of the peace, quiet and good order involving mor e than one family or
household member and does not meet the requirements of domestic violence.
Domestic Violence – any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual
battery, stalking, aggravated stalking, kidnapping, false impri sonment or any criminal offense resulting in
physical injury or death of one family or
