PURPOSE To establish guidelines and procedures for tracking of sexual o ffenders per Florida State Statue § 943.0435 and sexual predators per Florida State Statute § 775.21, who reside within the City of Sunny Isles Beach. B. SCOPE This directive is applicable to all sworn members of the Depart ment. C. POLICY 1. The City of Sunny Isles Beach Police Department recognizes that sexual predators and sexual offenders pose a substantial risk to our commun ity. These offenders, by nature, victimize the unsuspecting and the young. It is in their nature to re-offend. The Florida Legislature passed th e Florida Public Safety Act (Senate Bill 958, Ch. 97-299, Laws of Florida), to simplify sexual predator community notification standards, to expand registration obligations to sexual offenders as well as sexual predators, to revitalize general felon registration, and improve the safety and well-being of our citizens and visitors. It shall be the policy of the C ity of Sunny Isles Beach Police Department to utilize every available resource in our mission to protect our citizens by complying with the proce dures set forth in the Act. All reasonable efforts will be made to ensure that sexual predators and offenders with in our community abide by registration and other restrictions placed upon them. . D. DEFINITIONS Conviction: A determination of guilt was the result of a plea or a trial regardless of whether adjudication is withheld. (FSS § 775.21(2)(e)). Distance determination: For purposes of determining the minimum distance separation re quirement outlined in Florida State Statutes and Miami -Dade County Ord inances, the re quirement shall be measured by following a straight line from the outer prop erty line of the permanent res idence or temporary residence to nearest outer property line of a school, designated public school bus stop, d ay care center, park, playground, or other place where children regularly congregate . Juvenile Sex Offender: An offender defined in FSS § 985.475 Permanent Residence: A place where the person abides, lodges, or resides for a peri od of three (3) or more consecutive days.
